Vlastnictví Zdravotnické zařízení si ponechá a bude uchovávat Zdravotní záznamy. Zdravotnické zařízení a Zkoušející převedou na Zadavatele veškerá svá práva, nároky a tituly, včetně práv duševního vlastnictví k Důvěrným informacím (ve smyslu níže uvedeném) a k jakýmkoli jiným Studijním datům a údajům.
Classroom Management The certificated classroom teacher demonstrates in his/her performance a competent level of knowledge and skill in organizing the physical and human elements in the educational setting.
Network Management 60.1 CLEC and CenturyLink will exchange appropriate information (e.g., network information, maintenance contact numbers, escalation procedures, and information required to comply with requirements of law enforcement and national security agencies) for network management purposes. In addition, the Parties will apply sound network management principles to alleviate or to prevent traffic congestion and to minimize fraud associated with third number billed calls, calling card calls, and other services related to this Agreement.
MANAGEMENT GRIEVANCES 15.01 It is understood that the Management may bring forward at any meeting held with the Union Representative any complaint with respect to the conduct of the Union, its Officers, Representatives, or Stewards, and that if such complaint by Management is not settled to the mutual satisfaction of the conferring Parties, it may be treated as a grievance and referred to arbitration in the same way as the grievance of any employee.
DUŠEVNÍ VLASTNICTVÍ The Service Provider acknowledges and agrees that the Sponsor shall have exclusive ownership rights to all Study data, improvements, developments, discoveries, inventions, work, know-how and other rights (whether or not patentable), created, developed, and/or reduced to practice as a result of or in connection with the provision of the Services, the Study and/or the use of the Study Drug or the Confidential Information, together with all intellectual property rights relating thereto (“Intellectual Property”). The Service Provider shall promptly disclose in writing to PSI and the Sponsor all Intellectual Property made by the Service Provider or the Service Provider Staff. At the Sponsor's request, the Service Provider shall cause all rights, titles and interests in and to any such Intellectual Property to be assigned to the Sponsor without additional compensation and provide reasonable assistance to obtain patents, including causing the execution of any invention assignment or other documents. Poskytovatel služeb uznává a souhlasí, že Zadavatel bude mít výhradní vlastnická práva ke všem Studijním údajům, vylepšením, na vývoj, k objevům, vynálezům, dílům, know-how a dalším právům (ať už patentovatelným či nikoli), vytvořeným, vyvinutým, a/nebo uvedeným do praxe v důsledku nebo v souvislosti s poskytováním Služeb a/nebo používáním Studijního léku nebo Důvěrných informací společně s právy duševního vlastnictví s nimi souvisejícími (dále jen „Duševní vlastnictví“). Poskytovatel služeb bude neprodleně písemně informovat Zadavatele o veškerém Duševním vlastnictví vytvořeném Poskytovatelem služeb a/nebo Personálem poskytovatele služeb. Na žádost Zadavatele zajistí Poskytovatel služeb převod veškerých práv a zájmů týkajících se Duševního vlastnictví na Zadavatele bez další odměny a poskytne přiměřenou součinnost k získání patentu včetně zajištění podpisu dokumentů k převodu objevu nebo jiných dokumentů.
Platby In consideration for the proper performance of the Study by Site in compliance with the terms and conditions of this Agreement, payments shall be made in accordance with the provisions set forth in Attachment A, with the last payment being made after the Site completes all its obligations hereunder, including without limitation answering all CRF-related queries, and IQVIA has received all properly completed CRFs and Site has returned or destroyed, at Sponsor’s option, all other Confidential Information (as defined below) in accordance with this Agreement. The estimated value of financial payment under this Agreement shall be approximately CZK 941 684. V souvislosti s řádným plněním Studie Místem provádění klinického hodnocení, a to v souladu s podmínkami a ustanoveními této Smlouvy, budou poskytovány platby dle podmínek a ustanovení definovaných v Příloze A, přičemž poslední platba bude uskutečněna poté, co Místo provádění klinického hodnocení splní a dokončí veškeré závazky, jež mu vyplývají z této Smlouvy, např. zodpovězení všech dotazů k formulářům CRF, a IQVIA obdrží veškeré řádně vyplněné CRF a Místo provádění klinického hodnocení podle uvážení Zadavatele vrátí nebo zničí veškeré další Důvěrné informace (ve smyslu níže uvedené definice). Předpokládaná hodnota finančního plnění dle této Smlouvy činí přibližně 941 684Kč.

Management Grievance The Employer may initiate a grievance at Step 3 of the grievance procedure by the Employer or designate presenting the grievance to the President of the Union or designate. Time limits and process are identical to a union grievance.
