Railroad Right-of-Way. “Railroad Right-of-Way” means the right-of-way of any rail line registered with the California Public Utilities Commission, except for High-Speed Rail right-of-way.
Railroad Right-of-Way. There shall, specifically, be no hunting, driving, ATVs or food plots on any railroad or railroad right-of-way on the Leased Property.
Railroad Right-of-Way a. The Railroad Right-of-Way accommodates existing tracks, drainage systems, multiple utilities, access roads, Railroad support facilities and space for future track(s).
Railroad Right-of-Way. The limits of property owned, controlled and/or operated upon by the Railroad. Shoofly: A temporary track built to bypass an obstruction or construction site. Siding: A track connected to the Main Track used for storing or passing trains.
Railroad Right-of-Way. The “Operational Right-of Way” (“ROW”) is comprised of the trackbed, all materials within the trackbed (the rail, ballast, ties, etc.), the ground areas and/or platform areas that are within 10-feet from the outer edge on both sides of the trackbed, the vertical area above the trackbed/ground/platform extending 10-feet from the track centerline, and the ground beneath all rail-related infrastructure and facilities. The ROW, as defined above, is not part of the Premises, is not being leased to the Lessee, is not to be subleased or sublicensed, and is not to be accessed or used by the Lessee or by any sublessee or sublicensee. SEPTA has no intention to abandon any portion of the ROW, nor shall the ROW or any portion thereof be deemed or construed as abandoned for any reason or purpose. Because it is not possible to itemize and list every aspect of the Premises and SEPTA Property, the above descriptions are provided to help understand what is intended to be, and to not be, a part of what is leased hereunder.
Railroad Right-of-Way. The Railroad right-of-way accommodates existing tracks, drainage systems, multiple utilities, Access Roads and space for future track(s). The proposed Grade Separation Project shall not limit current or future Railroad operating capacity and utility accommodations within the Railroad right-of-way.
Railroad Right-of-Way. No mining activity of any kind may be conducted within the Burlington Northern/Chicago and Northwestern railroad right-of-way. The lessee shall recover all legally and economically recoverable coal from all leased lands not within the foregoing right-of-way. Lessee shall pay all royalties on any legally and economically recoverable coal which it fails to mine without the written permission of the Authorized Officer.
