Random Testing. 24.5.1 The annual percentage rate for random alcohol testing is 25% of the average number of driver positions. The annual percentage rate for random controlled substance testing is 50% of the average number of driver positions. These rates, which are required by FHWA regulations, will be automatically adjusted to be consistent with changes, if any in the minimum rated required by these regulations. (See 49 C.F.R. The annual percentage rate for random controlled substance testing is at least 50% of the average number of driver safety sensitive positions. These rates, which are required by FHWA regulations, will be automatically adjusted to be consistent with changes, if any any, in the minimum rated rates required by these regulations. (See 49 C.F.R. Section §382.305, subd, . (a).)) The District will notify the Association of any change in these amounts prior to implementation. The intent of “at least” is to establish a number that will meet but not exceed the minimum requirements of 25% and 50% respectively.
