Common use of Real Living Wage Clause in Contracts

Real Living Wage. a) The Supplier shall and shall also procure that its relevant sub-contractors (if any) shall: (i) ensure that none of its workers or its sub-contractor’s workers engaged in the performance of this Agreement in London and the rest of the UK and who would also satisfy the eligibility criteria set by the Living Wage Foundation (or any replacement thereof) is paid an hourly wage (or equivalent of an hourly wage) less than the Real Living Wage; and (ii) co-operate and provide all reasonable assistance to Network Rail in monitoring the effect of the Real Living Wage. b) If the Real Living Wage increases during the term of this Agreement, the Supplier shall not be entitled to adjust the Contract sums and the Parties agree and acknowledge that any increases in the Real Living Wage anticipated during the term of this Agreement have been factored into the Contract sum. c) Any failure by the Supplier to comply with the provisions of Clause 20a) shall be treated as a material breach under this Agreement.
