Reassignment of Personnel Initiated by Department. If staffing levels among the shifts become imbalanced, the Department may reassign personnel from one shift to another in accordance with the provisions of this paragraph. The preference of the Department is to accomplish the rebalancing with volunteers. However, because of the time involved in the posting process, rebalancing of the shifts may initially be accomplished by inverse classification seniority. When inverse seniority is used, the Department shall give not less than seven (7) calendar days advance notice to affected employees prior to the effective date of such reassignments. In order to solicit volunteers, the Department shall also make a one-time posting of the assignments made available by reason of the rebalancing and consider transfer requests in the manner specified in paragraphs A and B, above. After the period to submit transfer requests for the posted assignments has expired, requested transfers shall be considered and granted in the manner specified in paragraph B, above. An employee initially reassigned by inverse seniority to an assignment and subsequently displaced by a volunteer from the one-time posting may be reassigned at the discretion of the Department. Notwithstanding any provisions of paragraph B to the contrary, following reassignment initiated by the Department under this paragraph (whether accomplished by inverse seniority or voluntary transfer), the Department will grant to a reassigned employee days off from their new shift corresponding to previously granted days off from their old shift when the employee can reasonably demonstrate that they had made plans for time off and that the inability to take time off during in accordance with such plans would cause a hardship to the employee. In all other cases, the Department shall use its best efforts to work with an affected employee to schedule days off at a time mutually acceptable to the Department and the employee.
