Common use of Reclassification of Current Classifications Clause in Contracts

Reclassification of Current Classifications. a) If an Employee or the Union believes that due to changes in the duties or responsibilities of a position, an Employee is improperly classified, the Employee or the Union may request a reclassification review in writing to the department head. b) The Employer shall have sixty (60) days from the date of the request to review and report on the outcome of the review. The Employee and the Union shall receive a copy of the report. Such report shall include the classification the position would be assigned to, a copy of any new or amended job description and the proposed rate of pay. c) The Union shall have thirty (30) days in which to challenge the accuracy of a new or amended job description, or the decision of the Employer. d) Failing settlement of the dispute, the dispute may be referred to Step 3 of the grievance procedure. e) If the Employer believes that due to changes in the duties or responsibilities of a position, an Employee is improperly classified, the Employer may provide a reclassification in accordance with Article 20.04. A reclassification initiated by the Employer will not be considered a vacancy unless the new classification results in an additional position being created.
