Recognition of rights. i. The Parties acknowledge the regulation of Union entry to workplaces under the Fair Work Act and the applicable safety legislation, and recognise their obligation to comply with the requirements of these laws when rights are being exercised under that legislation. The Parties agree that nothing in this clause can deprive any Party of their rights or remedies under the Fair Work Act and WHS Act. ii. The Company will not refuse or unduly delay entry onto a site by Union officials who are entitled to enter the site in accordance with the Fair Work Act and applicable safety legislation. iii. The Parties recognise that Union officials can enter a site at the express invitation of the Company for other purposes and that any such invitation maybe withdrawn at any time at the discretion of the Company.
