Common use of Recurrence Clause in Contracts

Recurrence. ‌ An employee who suffers a recurrence of disability with one hundred eighty (180) days of the employee’s return to work will become eligible for the remaining portion of benefit according to the salary continuance schedule, without serving forty (40) hour waiting period, provided: a. The recurrence occurs within 180 days of the employee’s return to work; an b. The recurrence is due to the same cause; or c. The recurrence is due to a related cause. A recurrence which occurs more than one hundred eighty (180) days after the initial return to work will be treated as a new illness, injury or disability.
