AWARD The State reserves the right to evaluate proposals and award contracts in a manner utilizing criteria selected at the State's discretion and in the State’s best interest. After evaluation of the proposals, or at any point in the RFP process, the State of Nebraska may take one or more of the following actions: Amend the RFP; Extend the time of or establish a new proposal opening time; Waive deviations or errors in the State’s solicitation process and in bidder proposals that are not material, do not compromise the RFP process or a bidder’s proposal, and do not improve a bidder’s competitive position; Accept or reject a portion of or all of a proposal; Accept or reject all proposals; Withdraw the RFP; Elect to rebid the RFP; Award single lines or multiple lines to one or more bidders; or, Award one or more all-inclusive contracts. The State of Nebraska may consider, but is not limited to considering, one or more of the following award criteria: Price; Location; Quality; Delivery time; Bidder qualifications and capabilities; State contract management requirements and/or costs; and, The RFP does not commit the State to award a contract.   • REFERENCE CHECKS The contact person listed as a reference shall be someone who has personal knowledge of the Proposer’s performance during the referenced contract. Contact persons shall have been informed that they are being used as a reference and that the County may be contacting them. More than one person can be listed but all shall have knowledge of the project. DO NOT list principals or officers who will not be able to answer specific questions regarding the project. Failure of references listed to respond to the County’s inquiries may negatively impact the evaluation of the Proposal. The reference shall be the owner or a representative of the owner.
