Reference System. All service-related information in this SLA relates to the quality, owed by the Supplier, of the software to be provided to the Client for its use at the hand-over point of the data network operated by the Supplier pursuant to the underlying Prime Agreement. Reference System. Generally the reference system, which serves as the baseline for comparison, is directly linked to and dependent upon the goal and scope of the LCA. In most cases, the reference systems for electric vehicles are mainly gasoline and/or diesel ICE vehicles with their current and future technologies. As transportation biofuels become a reality on the fuel market in more countries, e.g., 7 vol-% blending of biodiesel in diesel in Austria, the aspects of biofuels should be integrated in the reference system more often in the future. In some countries, natural gas vehicles (including their new infrastructure) might be part of the reference systems. As described already in section 3.3, when the environmental effects of electric vehicles might be maximized by using renewable electricity, the additional renewable electricity must be generated and not be taken away from base load electricity demand. In such cases, environmental effects associated with this additional renewable electricity production, e.g., building a dam for a hydro power plant, must then be considered for the electric vehicles evaluation. Reference System. 12.1. FUMBI gives the User possibility to refer new users through the reference system available on the Platform (the "Reference System"). 12.2. The Contractual Parties have agreed that should the User successfully refer a new user, FUMBI is entitled to provide a reward to the User in accordance with conditions specified in this Agreement. A successfully referenced user is a person who establishes the Account via Platform, uses data intended for referring users according to Article 12.3, and makes a Deposit under the terms of this Agreement (the “New User”). 12.3. Should a New User make a Deposit (the “New User's Deposit”), FUMBI is entitled to provide the User with a reward, as mentioned in terms of this Agreement (the “Reward”). 12.4. The Reference System or activities related to it do not constitute a contractual relationship of commercial representation, intermediation, or any other authorization to represent FUMBI or to act on its behalf of FUMBI by the User. 12.5. The User is obliged to use the Reference System exclusively in accordance with this Agreement. When using the Reference System, the User undertakes that: a) the User will not use the Reference System to perform an illegal activity, fraud, in a manner that contradicts provisions of the Agreement or contravenes good morals; b) the User will not use the Reference System with the use of unwanted messages addressed to third parties in either electronic or paper form; c) the User will not present themselves as a person authorized to act in the name or on behalf of FUMBI or its authorized representative, business partner, or intermediary or to act in any way that would indicate such a fact. 12.6. FUMBI is entitled, but not obliged, to pay the User the Remuneration in case a New User's Deposit is made in accordance with the terms of this Agreement. The model for calculating Reward is listed on the Platform. The Reward will be paid to the User by crediting the relevant amount of the Reward to the value of the Deposit which belongs to that particular User in the form of cryptoassets. 12.7. Should the User receive the Reward in contradiction with the terms of the Reference System, the terms of this Agreement or should the Reward be acquired by any other unauthorized manner, the User is obliged to return the value of such Reward and compensate for the damage...
Reference System. All performance figures of this SLA refer to the quality of services regarding the com.xxx Xxxxxx – Software which is provided by Xxxx at the data transfer interface of Xxxx´s data network in accordance with the com.xxx Portal – Software License Agreement. Data transmission impairments between this data transfer interface and Customer and/or impairments of Customer´s IT system are left out of consideration. The data transfer interface is defined as the router of the internet service provider in the data network of Xxxx.

  • TECHNICAL EVALUATION (a) Detailed technical evaluation shall be carried out by Purchase Committee pursuant to conditions in the tender document to determine the substantial responsiveness of each tender.   • Usage Statistics The Distributor shall ensure that the Publisher will provide access to both composite system-wide use data and itemized data for the Licensee, the Participating Institutions, individual campuses and labs, on a monthly basis. The statistics shall meet or exceed the most recent project Counting Online Usage of NeTworked Electronic Resources ("COUNTER") Code of Practice Release,3 including but not limited to its provisions on customer confidentiality. When a release of a new COUNTER Code of Practice is issued, the Distributor shall ensure that the Publisher will comply with the implementation time frame specified by COUNTER to provide usage statistics in the new standard format. It is more than desirable that the Standardized Usage Statistics Harvesting Initiative (SUSHI) Protocol4 is available for the Licensee to harvest the statistics.

  • Data Aggregation Services BA is also permitted to use or disclose information to provide data aggregation services as that term is defined by 45 CFR 164.501, relating to the health care operations of CE.
