References to County Ordinances. This Agreement hereby incorporates by reference Beaufort County, South Carolina, Ordinances 2005-33 2008-29, and 2009-21 regarding the establishment of a Stormwater Utility. In the case of any conflict between the provisions of the Ordinances and this Agreement, the provisions of this Agreement shall control.‌‌‌‌‌
References to County Ordinances. This Agreement is in furtherance of the implementation of York County Ordinances Nos. 2718 and 2818, in final form, as referenced herein, exemplar copies of which have been provided to the City for review.

Notwithstanding the foregoing, the Parties agree that the amount of the Development Impact Fee may be adjusted annually (on December 1st of each year of this Agreement) to reflect the effects of inflation on the system improvement costs using the Construction Cost Index calculated by the Engineering New Record (ENR) for the most recent month for which such figures are available. The County shall be responsible for providing notice to the City of any annual adjustments.
