Common use of Referral to City Manager Clause in Contracts

Referral to City Manager. If the grievance is not resolved within the Department within thirty (30) days of filing with the Fire Chief, the employee or Union representative may notify the City Manager in writing that a grievance exists. Such notifications shall state the particulars of the grievance and, if possible, the nature of the determination which is desired. A grievance which has been heard and investigated pursuant to this Section and Section 26.1 and which remains unresolved thirty (30) calendar days after it has been submitted in writing may be referred to the Adjustment Board. The grievance shall be heard by the Adjustment Board within ninety (90) days of the Union notifying the City Manager as stated above.
