Refund of Fees. The fees referred to in this Clause 23 and the Fee Letter shall not be refunded under any circumstances whatsoever once they have been paid.
Refund of Fees. If the Licensee is not in breach of the Agreement, and Nearmap elects to terminate the Agreement under section 6.3, Nearmap will refund the Licensee any pre-paid fees relating to the portion of Term remaining as at the date of termination.

Although Xxxxxx will make a diligent effort to obtain refunds of any international fees paid to a foreign authority/service provider/contractor, it cannot guarantee a refund. If applicants withdraw from the adoption process for any reason, or if the adoption fails for any reason, Xxxxxx cannot guarantee the return of any portion of the international fees. If fees are returned, Xxxxxx will approve the refund decision and return the fees to the applicants within sixty days.

Licensee shall not be entitled to a refund of fees (or any portion thereof) upon termination of this Agreement, irrespective of the timing of termination (i.e., whether termination occurs one month, ten months, or more after the fee has been paid and the associated Certificate has been issued).

Where the Resident leaves the Nursing Home temporarily (otherwise than as covered by clause 3.14) during any period in respect of which the fees under this Agreement have been paid and the Proprietor achieves a material saving due to the Resident’s absence from the Nursing Home, the saving shall be passed on to the Resident.

(a) You do not enter into any other Finance Agreement within a period of 6 months commencing on the date We submit a Lending Proposal, or if there is more than one Lending Proposal submitted by Us, the first Lending Proposal; or
(b) Within the period referred to in (a) You accept a Finance Offer and enter into a Finance Agreement but exercise a right to withdraw under section 66A of the Consumer Credit Act 1974 or a right to cancel under section 69 of the Consumer Credit Xxx 0000: then We shall refund the Broker Appraisal Fees / Arrangement Fee paid under this Agreement less
3.3.2 If clause 3.3.1 of this agreement applies then the refund shall be paid by Us within 30 days of the end of the period referred to in 3.3.1. (a) above or the date upon which it is clear to Us that the Finance Offer will not proceed to Completion whichever is sooner.
3.3.3 If the circumstances referred to in clause 3.3.1 apply, and Fees have become due, they will cease to be payable.
3.3.4 For the avoidance of doubt, no Fees are refundable, or cease to be payable, if the Lending Proposal comprises a Regulated Mortgage Contract or Home Finance Plan.
