Rejection of Payment Orders. The Custodian shall give the Fund timely notice of the Custodian’s rejection of a payment order. Such notice may be given in writing or orally by telephone, each of which is hereby deemed commercially reasonable. In the event the Custodian fails to execute a properly executable payment order and fails to give the Fund notice of the Custodian’s non-execution, the Custodian shall be liable only for the Fund’s actual damages and only to the extent that such damages are recoverable under UCC 4A (as defined in Paragraph 7 below). Notwithstanding anything in this Funds Transfer Services Schedule and the Agreement to the contrary, the Custodian shall in no event be liable for any consequential or special damages under this Funds Transfer Services Schedule, whether or not such damages relate to services covered by UCC 4A, even if the Custodian has been advised of the possibility of such damages. Whenever compensation in the form of interest is payable by the Custodian to the Fund pursuant to this Funds Transfer Services Schedule, such compensation will be payable as specified in UCC 4A.

Rejection of Payment Orders. If the Bank receives notice that a payment order issued and transmitted by the Bank to the Federal Reserve Bank to carry out a payment order from you is rejected, the Bank shall notify you by telephone, electronic transmission, or by United States mail, either of which shall be considered commercially reasonable, of such rejection. Such notice shall identify the rejected payment order, state the date on which the Bank received notice of such rejection, and state any reason given for such rejection. Except for a payment order transmitted by you in accordance with this Agreement, the Bank shall have no obligation to retransmit a rejected payment order if the Bank complied with this Agreement with respect to the original payment order.

Such notice may be given in writing or orally by telephone, each of which is hereby deemed commercially reasonable, in accordance with all applicable security procedure adopted by the parties. Notwithstanding anything in this Funds Transfer Services Schedule and the Agreement to the contrary, the Custodian shall in no event be liable for any consequential or special damages under this Funds Transfer Services Schedule, even if the Custodian has been advised of the possibility of such damages.
Rejection of Payment Orders. Except as otherwise expressly provided in a written agreement signed by Bank, Bank has the right to reject any Payment Order for any reason, if Bank acts in good faith, including (a) your failure to have or maintain immediately available funds in your Account sufficient to settle the Payment Order, (b) if Bank believes in good faith the Payment Order or your instructions were not authorized, or (c) the transfer would result in a violation of any applicable law, regulation, court order, or the rights of any third party. If Bank rejects any Payment Order communicated to Bank in accordance with the Security Procedures, Bank will use reasonable efforts to notify you by phone or other reasonable means no later than the Business Day that Bank would have executed the rejected Payment Order. Bank is not liable to you for Bank’s rejection of any Payment Order, or the fact that any notice of rejection was not given to you at an earlier time.
Rejection of Payment Orders. If OANDA determines not to honor or execute a Payment Order received from you in accordance with section 1.1, it shall endeavor to notify you of such determination by email, fax or telephone. Payment Orders communicated to OANDA in a manner that does not comply with Section 1.1 may not be executed by OANDA and you may not receive notice of rejection.

Rejection of Payment Orders. We may in our discretion reject a payment order for any reason, including without limitation in the case of insufficient or inconsistent data, questionable authority, suspected fraud or illegal activity, insufficient funds, or setoff claims by us or third party claims against your funds. If we reject or fail to execute a payment order of yours, we will use reasonable efforts to promptly notify you of the rejection orally, electronically, in writing, or using any other method we choose.

Rejection of Payment Orders. Bank is not obligated to accept or execute any payment order. Bank may reject any payment order or incoming wire transfer which does not conform to the limitations, Security Procedures, and/or other requirements set forth in this Agreement. Bank will use any commercially reasonable method to give notice to Customer of its rejection or failure to execute any payment order of Customer within the timeframes stated in this Agreement. If the payment order is received by Bank on or before the cut off time established by Bank from time to time (“Cut Off Time”) on the execution date of the payment order, Bank will give such rejection notice on the execution date of the order. If the payment order is received after the Cut Off Time on the execution date of the payment order, such rejection notice shall be given no later than the next funds transfer day following the execution date of the payment order. If Customer has paid a fee to Bank for a payment order that Bank has rejected or failed to execute, Bank will reimburse Customer for those fees and pay compensation for the use of those funds as set forth in Section 3.
