Relationship to Other Regulatory Requirements. The terms ofthis Agreement are consistent with and will be governed by and construed in accordance with the ESA, CESA and other applicable State and federal laws. In particular, nothing in this Agreement is intended to limit the authority of USFWS, NMFS and CDFW to seek penalties for violations of, or otherwise fulfill its responsibilities under, the ESA or CESA. Moreover, nothing in this Agreement is intended to limit or diminish the legal obligations and responsibilities of USFWS or NMFS as agencies ofthe federal government or CDFW as an agency ofthe State of California.
