Common use of Relieved of Promotion or Transfer Clause in Contracts

Relieved of Promotion or Transfer. An employee who requests to be relieved of a transfer or pro- motion within the first ninety (90) days in the new job shall be returned to the employee’s former job or a mutually acceptable alternative position without loss of seniority and benefits. For the first three (3) calendar months in a new position a pro- moted employee shall be qualifying in that position and if unsatis- factory shall be returned to the employee’s previous classification and salary structure without loss of seniority and benefits. In the case of an employee promoted to a department head position, the time period will be four (4) calendar months.
