DEBARMENT, SUSPENSION, INELIGIBILITY AND VOLUNTARY EXCLUSION By executing this contract the firm affirms that it is in compliance with the requirements of 2 C.F.R. Part 180 and that neither it, its principals, nor its subcontractors are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency.
LAY-OFF & RECALL These provisions shall be utilized to protect regular employees, wherever possible, from loss of employment, with the exception of employees who are dismissed for cause.
First Offense The participant will not participate in the next contests/events, beginning with the first contest/event in which he/she would participate after determination that an infraction has occurred, equal to 20% of the number of regular scheduled contests/events. The participant will also be referred to the Centerville High School Crisis Intervention Counselor or their Middle School Guidance Counselor. The participant will be permitted to practice during the time period of his/her co- curricular suspension. The participant’s reinstatement and eligibility will be determined by the Athletic Director. OR: The number of contests/events to be suspended from can be reduced to 10% if the participant agrees to complete 20 hours of approved community service within 45 days of determination that an infraction has occurred. Failure to comply with this will add an additional 20% suspension at the end of 45 days plus all awards will be revoked. Proof of an approved community service plan being in place must be presented to the Athletic Director prior to being reinstated to participate after the 10% suspension has been served. All other consequences relating to intervention, practice, reinstatement, and eligibility remain the same. Second Offense: The participant will not participate in any Centerville High School or Centerville Middle Schools co-curricular activity for one calendar year from the date of determination that a second infraction has occurred. The participant will also be referred to the Centerville High School Crisis Intervention Counselor or their Middle School Guidance Counselor. The participant will not be permitted to practice or take part in any co-curricular events during this time period. The participant’s reinstatement and eligibility will be determined by the Athletic Director. OR: The suspension can be reduced to 6 months if the participant agrees to complete 40 hours of approved community service within 90 days of determination that an infraction has occurred. Failure to comply with this will result in a year suspension beginning at the end of 90 days. All other consequences relating to intervention, reinstatement, and eligibility remain the same. Third Offense (and subsequent offenses): The participant will not be eligible for further participation in any Centerville High School or Centerville Middle Schools co- curricular activities for the remainder of their school career. The participant may apply for reinstatement at the conclusion of one calendar year from the date of determination that an infraction has occurred. This application should be made to the Athletic Director in writing and must include proof of completing an intervention program with, or approved by, the CHS Crisis Intervention Counselor or their Middle School Guidance Counselor and also proof of completing 100 hours of approved community service during this year’s suspension. The participant’s reinstatement and eligibility will be determined by the Athletic Director.
QUALIFYING USE The Applicant’s Qualified Property described in Section 3.3 qualifies for a tax limitation agreement under Section 313.024(b)(5) of the TEXAS TAX CODE as a renewable energy electric generation facility.
Professional Development; Adverse Consequences of School Exclusion; Student Behavior The Board President or Superintendent, or their designees, will make reasonable efforts to provide ongoing professional development to Board members about the adverse consequences of school exclusion and justice-system involvement, effective classroom management strategies, culturally responsive discipline, appropriate and available supportive services for the promotion of student attendance and engagement, and developmentally appropriate disciplinary methods that promote positive and healthy school climates, i.e., Senate Bill 100 training topics. Board Self-Evaluation The Board will conduct periodic self-evaluations with the goal of continuous improvement. Third-Party Offerings Dell may offer Third-Party Products for use with the APEX Service through an online marketplace, or using Dell’s then-current Third-Party Product resale programs (e.g. “Extended Technologies Complete”, “Software & Peripherals (S&P)”). Third-Party Products that Distributor orders from Dell through these resale programs are referred to as “Third-Party Offerings”. Distributor may offer Third-Party Offerings to Reseller to offer to Customer for Customer’s use, at Distributor’s option, if available. If Distributor chooses to offer Third-Party Offerings to Reseller for Reseller to offer to Customer for Customer’s use, Distributor, Reseller, and Customer are responsible for complying with any terms applicable to the Third-Party Offerings, including any separate fees imposed by the provider of that Third-Party Offering (whether payable to Dell or directly to the third-party provider). Distributor agrees to comply with the standard license, services, warranty, indemnity, and support terms of the third-party manufacturer/supplier (or an applicable direct agreement between Distributor and the third-party manufacturer/supplier) for the Third Party Offering. Even if Dell invoices for them, Dell does not provide support services for Third-Party Offerings. Distributor must contact the applicable third-party directly for support. Third-Party Offerings are provided “AS IS”. Any warranty, damages or indemnity claims against Dell for Third-Party Offerings are expressly excluded. Dell may suspend or terminate provision and hosting of any Third- Party Offerings at any time, and that suspension or termination will not be deemed a material change to the APEX Service for the purpose of Clause 3.2 (Material Modifications).
