Common use of REMOVAL OF UNSATISFACTORY PERSONNEL Clause in Contracts

REMOVAL OF UNSATISFACTORY PERSONNEL. The City may make written request to the Design-Build Firm for the prompt removal and replacement of any personnel employed or retained by the Design-Build Firm, or any or Sub-Design-Build Firm engaged by the Design-Build Firm to provide and perform services or Work pursuant to the requirements of the Contract Documents. The Design-Build Firm shall respond to the City within seven (7) calendar days of receipt of such request with either the removal and replacement of such personnel or written justification as to why that may not occur. The City shall make the final determination as to the removal of unsatisfactory personnel from Work assigned by City. The Design-Build Firm agrees that the removal of any of its employees does not require the termination or demotion of employee(s).

The Design-Build Firm agrees that Such decision shall not be construed as directing the removal of Construction Manager to terminate any of its employees does not require employee’s employment with the termination or demotion of employee(s)Construction Manager.
