Rentable Square Feet of Premises and Building. For purposes of this Lease, “rentable square feet” in the Premises and the Building, as the case may be, has been calculated pursuant to Landlord’s current method for measuring rentable square footage. Landlord and Tenant hereby stipulate and agree that the rentable area of the Premises is as set forth in Section 2.2 of the Summary and shall not be subject to adjustment as a result of any remeasurement.
Rentable Square Feet of Premises and Building. For purposes of this Lease, “rentable square feet” in the Premises, the Building and the Project, as the case may be, shall be calculated in accordance with the Standard Method for Xxxxxxxxx Xxxxx Xxxx xxx Xxxxxx Xxxxxxxxx, XXXX X00.0-0000, promulgated by the Building Owners And Managers Association (BOMA) (“Measurement Standard”). Notwithstanding anything to the contrary set forth in Section 2.2 of the Summary or elsewhere in this Lease, the rentable area of the Premises and any ROFO Spaces (as defined in Addendum 1) is subject to verification by Landlord’s space planner pursuant to the Measurement Standard from time to time (the “Measurement Verification”). In the event that Landlord’s space planner determines that the rentable area of the Premises shall be different from that set forth in Section 2.2 of the Summary, then all amounts, percentages and figures appearing or referred to in this Lease based upon such incorrect rentable area (including, without limitation, the amounts of “Base Rent,” the “Tenant Improvement Allowance,” and “Tenant’s Share,” as those terms are defined in this Lease, respectively) shall be modified in accordance with such determination. Notwithstanding the foregoing, if Tenant notifies Landlord that Tenant objects to the Measurement Verification within thirty (30) days after Tenant’s receipt of the Measurement Verification from Landlord, then, at Tenant’s sole cost and expense, the Premises shall be measured by an independent architect jointly selected by Landlord and Tenant and, if applicable, all amounts, percentages and figures appearing or referred to in this Lease based upon such incorrect rentable area (including, without limitation, the amounts of “Base Rent,” the “Tenant Improvement Allowance,” and “Tenant’s Share”) shall be modified in accordance with such determination. Notwithstanding the foregoing, Landlord may remeasure the Building and/or the Project, from time to time, in accordance with the Measurement Standard, and if the rentable area of the Premises, the Building and/or the Project shall change as measured in such remeasurement, then the rentable area of the Premises and/or the Building, as the case may be, shall be appropriately adjusted as of the date of such remeasurement based upon the written verification by Landlord’s space planner of such revised rentable area. Any such remeasurement by Landlord shall be subject to verification by Tenant in accordance with this Section 1.2.
Rentable Square Feet of Premises and Building. Landlord and Tenant hereby stipulate and agree that the rentable square feet of the Premises is as set forth in Section 2.2 of the Summary and the rentable square footage of the Building is 532,267 rentable square feet (the “Building RSF”), which rentable square footages shall not be subject to re-measurement or modification. For purposes of this Lease, “rentable square feet” in any First Offer Space shall be measured in accordance with the “Office Building: Standard Methods of Measurement ANSI/BOMA Z65.1-2017 (or then more current)” method (the “BOMA Standard”).
Rentable Square Feet of Premises and Building. For purposes of this Lease, the “usable square feet” and “rentable square feet” in the Premises and the Building, as the case may be, shall be calculated pursuant to Office Buildings: Methods of Measurement and Calculating Rentable Area – 2010, and its accompanying guidelines (“BOMA”), as interpreted for the Building by Landlord’s architect. Notwithstanding the foregoing, Landlord and Tenant hereby stipulate and agree that (i) the rentable area of the Building is as set forth in Section 2.1 of the Summary, and (ii) the rentable area of the Premises is as set forth in Section 2.2 of the Summary.
Rentable Square Feet of Premises and Building. For purposes of this Lease, all measurements shall be calculated pursuant to Standard Method for Measuring Floor Area in Office Buildings. ANSI Z65.I - 2010 (“BOMA”), provided that the square footage of the Building shall include all of, and the square footage of the Premises therefore shall include a portion of, the square footage of the ground floor common areas located within the Building and the common area and occupied space of the portion of the Building or Real Property, dedicated to the service of the Building. The rentable square feet of the Premises and the Building shall be as set forth in Sections 6.2 and 6.1 of the Summary, respectively and such square footages shall not be subject to verification or modification during the Lease Term except as set forth in the Summary.
Rentable Square Feet of Premises and Building. Notwithstanding anything set forth in this Lease to the contrary, Landlord and Tenant hereby stipulate and agree that the rentable area of the Building and the Premises is as set forth in Section 2 of the Summary.
Rentable Square Feet of Premises and Building. For purposes of this Lease, "rentable square feet" in the Premises and the Building, as the case may be, shall be calculated pursuant to Landlord's then current method for measuring rentable square footage. Landlord and Tenant hereby stipulate and agree that the rentable area of the Premises is as set forth in Section 2.2 of the Summary. Notwithstanding the foregoing, Tenant shall be entitled to remeasure the Premises within thirty (30) days after the Lease Commencement Date. If such remeasurement by Tenant results in a different rentable square feet of the Premises than the rentable square feet specified herein: (i) all variables under this Lease that are dependent upon such measurement (including Base Rent and Tenant’s Share) shall be proportionately adjusted retroactive to the Lease Commencement Date, and (ii) within ten (10) business days after such new determination, Landlord and Tenant shall confirm the same in writing by entering into a mutually acceptable amendment of this Lease modifying the rentable square feet of the Premises, Base Rent, Tenant’s Share, and any other matters set forth in this Lease affected by such change in the rentable square feet of the Premises; provided, however, that Base Rent shall not increase as a result of such remeasurement. In no event shall Landlord have the right to remeasure the Premises during the Term or any subsequent renewal period thereof.
Rentable Square Feet of Premises and Building. For purposes of this Lease, the square footages set forth in the Summary and all percentages based thereupon shall be deemed accurate and neither the Premises, Building nor Project shall be subject to remeasurement at any time.
Rentable Square Feet of Premises and Building. Landlord and Tenant --------------------------------------------- hereby stipulate that the Premises contains the number of rentable square feet specified in Section 6 of the Summary and that Tenant's Share is as specified in Section 9 of the Summary.
Rentable Square Feet of Premises and Building. Landlord and Tenant hereby stipulate and agree that (i) the RSF of the Building is as set forth in Section 2.1 of the Summary, (ii) the RSF of each floor of the Premises is as set forth in Section 2.2 of the Summary, and (iii) all such rentable square footages, except as expressly provided below, shall not be subject to remeasurement.
