REPLACEMENT OF MALFUNCTIONING EQUIPMENT. If equipment becomes unsafe or in disrepair, Xxxxxx agrees to discontinue use and notify the Lessor who will replace the equipment with similar equipment in good working order, if available. The Lessor is not responsible for any incidental or consequential damages caused by delays or otherwise.

If the equipment becomes unsafe or in disrepair as a result of normal use, Customer agrees to discontinue use and notify Rotisserie Bbqs Inc. immediately, who will replace the equipment with similar equipment in good working order if available. Rotisserie Bbqs Inc. is not responsible for any incidental or consequential damages caused by delays or otherwise.

If the equipment becomes unsafe or in disrepair as a result of normal use, abuse or neglect customer agrees to discontinue use and notify PLR who will replace the equipment with similar equipment in good working order, if available. In the case of abuse or neglect PLR may not replace the item at our sole discretion. PLR is not responsible and is held harmless for any incidental or consequential damages cause by delays or otherwise.

Lessor will repair or replace the equipment with similar equipment in good working order if available, and if the defect is the result of normal use. Lessor is not responsible for an incidental or consequential damages caused by delays or otherwise, and Lessee hereby waives any right or entitlement thereto.

XXXX XXXX LLC will repair or replace the equipment with similar equipment in good working order if available, and if the defect is the result of normal use. XXXX XXXX LLC is not responsible for any incidental or consequential damages caused by delays or otherwise, and Customer hereby waives any right or entitlement thereto. If XXXX XXXX LLC replaces the equipment and upon testing the original equipment, discovers that the equipment is in good working order, additional charges may occur for delivery of replacement equipment.
REPLACEMENT OF MALFUNCTIONING EQUIPMENT. If equipment becomes unsafe or in disrepair, xxxxxx agrees to discontinue use and notify L.E.A.P. Diversify Cayman Ltd. immediately. L.E.A.P. Diversify Cayman Ltd. will make every attempt to provide replacement equipment as soon as possible upon being alerted of the issue. We regret any malfunctions, but will try to resolve the problem as efficiently as possible.
REPLACEMENT OF MALFUNCTIONING EQUIPMENT. If the Front Runner becomes unsafe or is in disrepair as a result of normal use, the Borrower agrees to discontinue use and notify KCSWCD who will provide a replacement, if available. KCSWCD is not responsible for any incidental or consequential damages caused by delays or otherwise.

If the equipment becomes unsafe or in disrepair as a result of normal use, I will discontinue use and notify Alick’s who will replace (or repair) the rental equipment with similar equipment in good working order, if available. Xxxxx’s is not responsible for any incidental or consequential damages caused by delays or otherwise. If I own the equipment, any repair and/or replacement would be my financial responsibility. Warranties: Xxxxx’s does not extend a warranty of merchantability or fitness either expressed and/or implied. Furthermore, with regard to product(s) or service(s) provided, Xxxxx’s makes no warranty that the product or service is suited for my intended use, or that it is free from defects. Hold Harmless: I will indemnify and hold Xxxxx’s harmless from and against any and all claims of loss and/or bodily injuries (including death) resulting from use, operation and possession of said equipment to others and/or myself. Prohibited Uses: Use of this rental agreement in the following circumstances is prohibited and constitutes a breach of this contract (or an automatic conversion to sale): a) Use for illegal purpose or in an illegal manner b) Use when the equipment is in bad repair or is unsafe c) Improper or unintended use or misuse d) Use at an extended care facility without Xxxxx’s permission.
REPLACEMENT OF MALFUNCTIONING EQUIPMENT. If the equipment becomes unsafe or in disrepair as a result of normal use, customer agrees to discontinue use and notify Monterey Pines Golf Carts or Xxxxx'x Golf Carts respectively who will have the option to replace or repair the rental equipment.
