REQUIREMENT FOR RECORDATION. City shall record this Agreement, including all of the Exhibits, and submit proof of such recording to Owner/Developer, prior to the third reading of the Meridian Zoning Ordinance in connection with the re-zoning of the Property by the City Council. If for any reason after such recordation, the City Council fails to adopt the ordinance in connection with the annexation and zoning of the Property contemplated hereby, the City shall execute and record an appropriate instrument of release of this Agreement.

If for any reason after such recordation the Garden City Council fails to adopt the Rezoning Ordinance, the City shall execute and record an appropriate instrument of release of this Agreement.

Developer will record this document, including all the Exhibits, in conjunction with the formal adoption of CAR18-00000 by the Boise City Council, and immediately provide a recorded copy to City. Failure to comply with this Section will be deemed a default of this Agreement by Developer.
REQUIREMENT FOR RECORDATION. The Developer shall record this document, including all the Exhibits, prior to the formal adoption of CAR14-00003 by the Boise City Council. Failure to comply with this section shall be deemed a default of this Agreement by the Developer. If for any reason after such recordation the Boise City Council fails to adopt CAR14-00003, City shall execute and record an appropriate instrument of release of this Agreement.

City shall record either a memorandum of this Agreement or this Agreement, including all of the Exhibits, and submit proof of such recording to Owner/Developer, prior to the third reading of the Meridian Zoning Ordinance in connection with the re- zoning of the Property by the City Council. If for any reason after such recordation, the City Council fails to adopt the ordinance in connection with the annexation and zoning of the Property contemplated hereby, the City shall execute and record an appropriate instrument of release of this Agreement. The parties further agree to record all releases required to remove the Original Development Agreement from title to the Property.

Failure to comply with this section shall be deemed a default of the Agreement by Developer. If for any reason after such recordation City’s Council fails to adopt the applicable ordinance, City shall execute and record an appropriate instrument to terminate this Amendment.
