Responsibility for Customer Content. Client is solely responsible for any and all Customer Content (subject to protections provided by applicable Law) and the consequences of, and requirements for, distributing it. Client acknowledges and agrees that (a) uploading Customer Content onto a website does not establish a fiduciary or other relationship between Client and the owner of such Customer Content, on the one hand, and DynamicWeb, on the other hand, and, (b) DynamicWeb is (i) not required to treat as confidential or secret any Customer Content, (ii) not responsible for the use, loss, damage or alteration of such Customer Content by any site visitor (whether permitted or not), and (iii) not required to develop or use such Customer Content, and neither Client nor the owner of any Customer Content is entitled to any compensation from DynamicWeb.

Responsibility for Customer Content. Customer is solely responsible for the collection, creation, manipulation, and other uses of Customer Content. Customer is solely responsible for the compliance of Customer Content with any and all re gulations, laws, and policies that may govern the collection, storage, processing, use, or distribution of Customer Content. Customer agrees to handle and process notices sent to Customer (or any Customer affiliates) by any person or organization claiming that Customer Content violates such person’s rights or any applicable laws or regulations.
Responsibility for Customer Content. Customer is solely responsible for the legality, accuracy and quality of Customer Content, such as for ensuring that Customer’s collection, processing, storage and transmission Customer Content is compliant with all applicable Laws, as well as any and all privacy policies, agreements or other obligations Customer may maintain or enter into with its customers. Customer represents and warrants that: (a) no processing of Customer Content under this Agreement (whether by Company, its Affiliates, or if applicable the Hosting Provider) will violate any Law, proprietary right, or privacy right; and (b) it has obtained and will maintain all required consents and licenses, and will maintain all ongoing legal bases under relevant privacy Laws (if applicable), necessary to provide, make available, and otherwise expose Customer Content to Company, its Affiliates, and the Hosting Provider (if applicable).
Responsibility for Customer Content. OpSource specifically disclaims all liability, and Customer shall be solely responsible for the development, operation, and maintenance of Customer Content, including without limitation any software or applications made available to Customer’s administrators, users or authorized third parties. Customer shall, without limitation, be solely responsible for: 7.7.1. the technical operation of its Customer Content and all related equipment; 7.7.2. the accuracy and appropriateness of any Customer Content (including, among other things, any product-related materials); 7.7.3. ensuring that Customer Content is not illegal and does not promote illegal activities, including without limitation any activities that might be libelous or defamatory or otherwise malicious, illegal or harmful to any person or entity, or discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age; 7.7.4. ensuring that all Customer Content accurately and adequately discloses, either through a privacy policy or otherwise, how Customer collects, uses, stores, and discloses data collected from visitors, including, where applicable, that third parties (including advertisers) may serve content and/or advertisements and collect information directly from visitors and may place or recognize cookies on visitors’ browsers; and 7.7.5. any of Customer’s users’ or clients’ claims relating to the Customer Content or any Services utilized in connection with Customer Content.
Responsibility for Customer Content. You are solely responsible for the Customer Content that you upload, publish, display, link to, or otherwise make available via the Services, and you agree that Fieldbit is only acting as a platform for your use. Fieldbit will not review, share, distribute, or reference any Customer Content except as provided herein and as provided on the Commercial Agreement, or as may be required by law. Notwithstanding the foregoing, Fieldbit retains the authority to remove any Customer Content uploaded that it deems in violation of this Agreement, at its sole discretion.

You acknowledge and agree that (a) uploading Customer Content onto a website hosted by a Hosting Provider does not establish a fiduciary or other relationship between you and the owner of such Customer Content, on the one hand, or Dynamicweb, on the other hand, and, (b) Dynamicweb is (i) not required to treat as confidential or secret any Customer Content, (ii) not responsible for the use, loss, damage or alteration of such Customer Content by any site visitor (whether permitted or not), and (iii) not required to develop or use such Customer Content, and neither you nor the owner of any Customer Content is entitled to any compensation from Dynamicweb, except in cases of intentional misuse of such Customer Content or gross negligence or willful misconduct by Dynamicweb. You agree to defend, indemnify and hold harmless Dynamicweb against any claims, losses, damages, fines, and assessments made against Dynamicweb and any and all reasonable costs and expenses incurred in connection therewith (including without limitation reasonable attorney’s fees and expenses) arising from or relating to any inaccuracy in or breach of any of your representations, warranties, covenants and agreements contained in this Section 3.12 or any claim by a third party that the Customer Content violates the rights of such third party.

  • Responsibility for Damage Resident is solely responsible for any damage, defacement or loss arising within the assigned bedroom space. All assigned residents of an apartment are jointly and severally responsible for any damage, defacement or loss to common areas, other parts of the Property, fixtures or appliances, except for the portion of damages over $100,000 where it is finally established that Resident or one or more other residents of the apartment were solely at fault for the entire loss, in which case such person(s) will be solely responsible. Resident is fully responsible for the conduct of Resident’s guests, visitors, licensees and invitees (“Guests”), including without limitation harm to individuals or damage or defacement of any part of the Property or its fixtures or property of third parties (including other residents) by such Guests.
