Common use of Rest Periods After Overtime Clause in Contracts

Rest Periods After Overtime. (a) When overtime is necessary it shall, wherever reasonably practicable, be so arranged that the employee has at least ten (10) consecutive hours off duty between the work of successive days. (b) An employee who works so much overtime between the termination of their ordinary work on one day and the commencement of their ordinary work on the next day that they have not had at least ten (10) consecutive hours off duty between those times shall, subject to this clause, be released after completion of such overtime until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. (c) If, on the instruction of the Company, the employee resumes or continues work without having such ten (10) consecutive hours off duty, the employee shall be paid at the appropriate overtime rate until he/she is released from duty for such period and shall then be entitled to be absent until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Where there is a mutual agreement between the Company and the employee affected, eight consecutive hours may be substituted in lieu of ten (10) consecutive hours.

(b) 5.7.2 An employee who works so much overtime between the termination of their ordinary work on one day and the commencement of their ordinary work on the next day that they have not had at least ten (10) 10 consecutive hours off duty between those times shall, subject to this sub-clause, be released after completion of such overtime until the employee has had ten (10) 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. (c) If, on 5.7.3 Failing an instruction from the instruction of the Company, the Company that an employee resumes should not resume or continues continue work without having had such ten (10) 10 consecutive hours off duty, duty the employee shall be paid at the appropriate overtime ordinary hourly rate plus 100 percent until he/she is they are released from duty for such period and shall then be entitled to be absent until the employee has had ten (10) 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. Where there is a mutual agreement between the Company and the employee affected, eight consecutive hours may be substituted in lieu of ten (10) consecutive hours.
