RESTORATION OF RAILROAD'S PROPERTY. A. Upon the termination or revocation of this agreement, Contractor shall, at its own cost and expense, restore the Property to the same condition in which it was prior to Contractor’s entry. In case Contractor fails to restore the Property to its prior condition within 10 business days after the effective date of termination, Railroad may proceed with such work at Contractor’s expense.

RESTORATION OF RAILROAD'S PROPERTY. In the event Contractor, in any manner moves or disturbs any property of Railroad in connection with performance of the Work on Licensee's Facilities, then, Contractor shall, as soon as possible and at Contractor’s sole cost and expense, restore Railroad’s property to the same condition as the same were before such property was moved or disturbed.
RESTORATION OF RAILROAD'S PROPERTY. In the event Railroad or the Commission authorizes Contractor to take down any fence or structure on Railroad’s Right-of-Way or of Railroad, or in any manner move or disturb any of Railroad’s Right-of-Way or other property of Railroad in connection with the Work, Contractor shall, as soon as possible and at Contractor's sole cost and expense, restore such fence or structure or other property to the same condition as it was in before it was taken down, moved, or disturbed and Contractor shall indemnify and hold harmless Railroad, its officers, agents, and employees against and from any and all liability, loss, damages, claims, demands, costs, and expenses of whatsoever nature, including court costs and reasonable Contract No. attorney’s fees, which may result from any injury to or death of any persons whomsoever, or any damage to or loss or destruction of any property whatsoever, when such injury, death, damage, loss, or destruction grows out of or arises from the taking down of any fence or the moving or disturbance of any property. Railroad will not pay Contractor for any betterments or improvements by Contractor of such fence or other property.

  • Personal Property Insurance Lessee shall obtain, at Lessee's sole cost and expense, a policy of fire and extended coverage insurance including coverage for direct physical loss special form, and a sprinkler leakage endorsement insuring the personal property of Lessee. The proceeds from any personal property damage policy shall be payable to Lessee. All insurance policies required in 6 C) and 6 D) above shall: (i) provide for a certificate of insurance evidencing the insurance required herein, being deposited with Lessor ten (10) days prior to the Commencement Date, and upon each renewal, such certificates shall be provided 15 days prior to the expiration date of such coverage, (ii) be in a form reasonably satisfactory to Lessor and shall provide the coverage required by Lessee in this Lease, (iii) be carried with companies with the a Best Rating of A minimum, (iv) specifically provide that such policies shall not be subject to cancellation or reduction of coverage, except after 30 days prior written notice to Lessor, (v) name Lessor, Lessor's lender, and any other party with an insurable interest in the Premises as additional insureds by endorsement to policy, and (vi) shall be primary. Lessee agrees to pay to Lessor, as additional Rent, on demand, the full cost of the insurance policies referenced in 6 A) and 6 B) above as evidenced as insurance xxxxxxxx to Lessor which shall be included in the CAC. If Lessee does not occupy the entire Premises, the insurance premiums shall be allocated to the portion of the Premises occupied by Lessee on a pro-rata square footage or other equitable basis, as determined by Lessor. It is agreed that Lessee's obligation under this paragraph shall be prorated to the reflect the Commencement Date and the end of the Lease Term. Lessor and Lessee hereby waive any rights each may have against the other related to any loss or damage caused to Lessor or Lessee as the case may be, or to the Premises or its contents, and which may arise from any risk covered by fire and extended coverage insurance and those risks required to be covered under Lessee's personal property insurance. The parties shall provide that their respective insurance policies insuring the property or the personal property include a waiver of any right of subrogation which said insurance company may have against Lessor or Lessee, as the case may be.

  • Tenant’s Property All insurance proceeds payable by reason of any loss of or damage to any of Tenant’s Personal Property shall be paid to Tenant and, to the extent necessary to repair or replace Tenant’s Personal Property in accordance with Section 10.5, Tenant shall hold such proceeds in trust to pay the cost of repairing or replacing damaged Tenant’s Personal Property.

  • Premises and equipment 6.1 If necessary, the Customer shall provide the Supplier with reasonable access at reasonable times to its premises for the purpose of supplying the Services. All equipment, tools and vehicles brought onto the Customer’s premises by the Supplier or the Staff shall be at the Supplier’s risk.

  • Condition of the Contractor’s Property or Equipment The Contractor shall make the Property and/or equipment available to the Judicial Council, pursuant to the terms and conditions set forth in this Agreement. The Contractor shall immediately remedy any problem with the Property’s physical plant or equipment that impairs or diminishes the quality of the Program. The Contractor shall ensure the appropriate hot water, heating, and ventilation is provided at the Property during the Program, inclusive in the prices set forth herein.
