Restoration of the Deposit in Deposit. (1) When any debit of the amount in deposit from the Deposit Account is made by a Debit Card Transaction, you shall have no right to demand that any third party other than the Merchant (including the specified successor of the Merchant and the Bank) pay the amount of cash equal to the amount in deposit so debited or demand that the Bank restore the amount in deposit so debited to the original condition, even if the Debit Card Transaction Agreement is terminated (including termination by agreement) or lawfully ceases to be effective by cancellation or otherwise (including the cancellation of the Debit Card Transaction Agreement together with the cancellation of the underlying purchase and sale transaction).

If the Servicer deposits in such account any amount not required to be deposited therein, it may at any time withdraw such amount, any provision herein to the contrary notwithstanding.

  • Administration of the Contributions 1.1. The Bank shall be responsible only for performing those functions specifically set forth in this Agreement and shall not be subject to any other duties or responsibilities to the Donors, including, without limitation, any duties or obligations that might otherwise apply to a fiduciary or trustee under general principles of trust or fiduciary law.
