Retention of Protected Health Information. Except as otherwise limited in this Agreement, in the event that Business Associate determines that returning or destroying the Protected Health Information in accordance with Section 9.1 of this Agreement is not feasible, Business Associate shall provide to Covered Entity notification of the conditions that make return or destruction of the Protected Health Information not feasible and shall extend the protections of this Agreement to such Protected Health Information and limit further uses and disclosures of such Protected Health Information to those purposes that make the return or destruction not feasible, for as long as Business Associate maintains such Protected Health Information.

Retention of Protected Health Information. Notwithstanding Section 6(c) of this BAA, Business Associate and its subcontractors or agents shall retain all Protected Health Information throughout the term of the Agreement and shall continue to maintain the information required under Section 3(h) this BAA for a period of six (6) years after termination of the Agreement.
Retention of Protected Health Information. Notwithstanding Section 5(d) of this Agreement, Associate and its Subcontractors or Agents shall retain all Protected Health Information throughout the term of the Contract and shall continue to maintain the information required under Section 2(h) of this Agreement for a period of six (6) years from the date of creation or the date when it last was in effect, whichever is later, or as Required by Law. This obligation shall survive the termination of the Contract.
Retention of Protected Health Information. Business Associate and its subcontractors or agents shall retain all PHI throughout the term of the Agreement. Notwithstanding Section 5.3 of this BA Agreement, Business Associate and its subcontractors or agents shall not destroy records that remain subject to the six-year records retention requirements of the HIPAA Regulations, including the accounting required under Sections 3.7 and 3.8 of this BA Agreement, but shall either maintain such records pursuant to section 5.3(b) or return them to Covered Entity. See 45 CFR Sections 164.316(b) (records retention requirement in Security Rule); 164.530(j) (records retention requirement in Privacy Rule).
Retention of Protected Health Information. In the event that Wildcard Dental or any Subcontractor or Services Provider of Wildcard Dental believes in good faith that it is not feasible to destroy any Protected Health Information, within ten (10) days of the termination of this Services BAA Wildcard Dental will notify the Client in writing, and Wildcard Dental , the Subcontractor or Services Provider may retain such Protected Health Information subject to the protections of this Services BAA which apply reasonably to the retained information, and limit future uses or disclosures of the Protected Information to those purposes which made its return or destruction infeasible. Wildcard Dental shall destroy, or if applicable require any Subcontractor or Services Provider retaining such information to destroy, all such information once the purposes of such retention have been fulfilled.
Retention of Protected Health Information. The BA shall retain the CE’s PHI, including documentation of all unauthorized disclosures, while this Agreement is in effect, and securely maintain the PHI for a period of six years from the date of the record’s creation or the date the Agreement was last in effect, whichever is later, or as required by law. This obligation shall survive the termination of this Agreement.

  • Amendment of Protected Health Information 8.1 To the extent Covered Entity determines that any Protected Health Information is maintained by Business Associate or its agents or Subcontractors in a Designated Record Set, Business Associate shall, within ten (10) business days after receipt of a written request from Covered Entity, make any amendments to such Protected Health Information that are requested by Covered Entity, in order for Covered Entity to meet the requirements of 45 C.F.R. § 164.526.

  • Access to Protected Health Information 7.1 To the extent Covered Entity determines that Protected Health Information is maintained by Business Associate or its agents or Subcontractors in a Designated Record Set, Business Associate shall, within two (2) business days after receipt of a request from Covered Entity, make the Protected Health Information specified by Covered Entity available to the Individual(s) identified by Covered Entity as being entitled to access and shall provide such Individuals(s) or other person(s) designated by Covered Entity with a copy the specified Protected Health Information, in order for Covered Entity to meet the requirements of 45 C.F.R. § 164.524.

  • Protected Health Information “Protected Health Information” shall have the same meaning as the term “protected health information” in Section 160.103 and is limited to the information created or received by Contractor from or on behalf of County.

  • Electronic Protected Health Information “Electronic Protected Health Information” means individually identifiable health information that is transmitted by or maintained in electronic media.

  • Data Protection and Privacy: Protected Health Information Party shall maintain the privacy and security of all individually identifiable health information acquired by or provided to it as a part of the performance of this Agreement. Party shall follow federal and state law relating to privacy and security of individually identifiable health information as applicable, including the Health Insurance Portability and Accountability Act (HIPAA) and its federal regulations.

  • Unsecured Protected Health Information “Unsecured Protected Health Information” shall have the same meaning as the term “unsecured protected health information” in 45 CFR § 164.402.

The Business Associate must not use or further disclose protected health information in a manner that would violate the requirements of HIPAA Regulations.

  • Health Information Subject to all applicable privacy laws, the member irrevocably authorises any doctor or other person who may have, or may acquire, any information concerning their health to disclose such information to Specialty Emergency Services, and that this authority shall remain in force for a period of not less than 12 (twelve) months following the expiry date of this Membership Agreement.

  • Confidentiality of Health Information (a) A Nurse shall not be required to provide her or his manager/supervisor specific information regarding the nature of her or his illness or injury during a period of absence. However, the Employer may require the Nurse to provide such information to persons responsible for occupational health.
