RETURN OF DEFECTIVE GOODS. 9.2.1 All Goods sold have a 1 (one) year warranty against defects unless otherwise determined by Scoop Distribution. The Customer must keep their proof of purchase to verify the date of purchase. Please note that this warranty may fall away if the Goods have been altered contrary to instructions or after leaving the control of Scoop Distribution.

RETURN OF DEFECTIVE GOODS. All Goods supplied under this Purchase Order that do not meet with the approval of II-VI A&D’s Quality Assurance Department, that are shipped contrary to Purchase Order instructions or that are in excess of the quantity or quantities ordered under this Purchase Order, will be returned to Seller or held pending a mutual agreement between II-VI A&D and Seller regarding their disposition, subject to the Seller's risk of loss and sole expense.

RETURN OF DEFECTIVE GOODS. In the event that Xxxxx believes a Product, part or component manufactured by FAMCO is defective in material or workmanship during the Warranty Period, Buyer shall promptly notify FAMCO in writing of the problem. Upon receipt of such written notice, FAMCO will issue Buyer a Returned Goods Authorization (“RGA”) number that must accompany the Product, part or component returned to FAMCO for warranty consideration. This RGA number is valid for thirty (30) days from the time of its receipt. Upon receipt of the defective Product, part or component, FAMCO will make an evaluation, or if necessary, forward a defective part to the original manufacturer for warranty consideration. Buyer shall then be notified of the manufacturer’s determination. If the part is found to be defective in material or workmanship, the obligations of FAMCO are strictly and exclusively limited to the repair or replacement, at the option of FAMCO, of the defective Product, part or component. FAMCO agrees to pay all shipping charges, at UPS ground rates, for delivery to Buyer of repaired or replacement parts provided the submitted parts have proved to be defective and covered by this Warranty. Where expedited delivery of repaired or replacement parts is requested by Buyer, such additional shipping charges shall be paid by Xxxxx. • The Buyer must return any defective Product, part or component to FAMCO within (30) days of receipt of an RGA number (shipping costs prepaid by the Buyer). If the part is timely returned to FAMCO and the failure is confirmed to be the result of a manufacturing defect, the Buyer will be credited the amount invoiced (plus shipping) for the repaired or replacement part. In the event a defective part is not received within (30) days of receipt of the RGA number, the Buyer will be billed the total cost of the replacement part or repairs, plus shipping and handling for returning the repaired or replacement part.

  • Notice of Defects If, based on Consulting Engineer/Architect's involvement during the construction phase, Consulting Engineer/Architect observes or otherwise becomes aware of any defect in the work, he shall give prompt written notice to City of such defects and their approximate location on the Project. However, Consulting Engineer/Architect shall not have control over or charge of and shall not be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions, inspections and programs in connection with the work, since these are solely the contractor's responsibility under the contract for construction. Consulting Engineer/Architect shall not be responsible for the contractor's schedules or failure to carry out the work in accordance with the Contract Documents. Consulting Engineer/Architect shall not have control over or charge of acts or omissions of the contractor, contractor's subcontractors, or their agents or employees.
