Return of Defective Product. DISTRIBUTOR agrees, if so requested by SUPPLIER, to return to SUPPLIER at SUPPLIER’s expense, such Product that does not meet the Product specifications therefor, or to otherwise dispose of such Product, as instructed by SUPPLIER at SUPPLIER’s expense and in compliance with all applicable rules and regulations, as SUPPLIER may direct. If SUPPLIER does not so direct, within [***] following DISTRIBUTOR’s notification of non-conformity, DISTRIBUTOR may dispose of such Product as DISTRIBUTOR may deem reasonably appropriate and SUPPLIER shall reimburse DISTRIBUTOR for the reasonable costs and expenses of such disposal and DISTRIBUTOR shall certify to SUPPLIER in writing that such Product has been destroyed.

Return of Defective Product. 12.1 The Company agrees to return Products involved in a complaint within one (1) month upon request from BMS and at the BMS's sole expense. The Company agrees to clean and disinfect all Products which must be returned. The Company will ensure that remaining contamination risks are documented and the Product is adequately labelled according to international transport standards for dangerous/hazardous goods (e.g. ADR, IATA, RID, IMDG, ADN, etc.).
Return of Defective Product. In the event that any Product purchased by Technologies from Collagen fails to conform to the warranty set forth in this Article 4.4, Collagen's sole and exclusive liability and Technologies' exclusive remedy shall be to replace the Product, or if, at Collagen's sole determination, replacement is not practicable, refund Technologies for the amount actually paid by Technologies for any such Product; 7 provided, however, that: (i) Technologies promptly notifies Collagen in writing that such Product failed to conform, furnishes a detailed explanation of any alleged nonconformity, and requests a return material authorization number; and (ii) such Product is returned to Collagen by Technologies F.O.B. Collagen's shipping location in Fremont, California, during the Warranty Period, with the return material authorization number affixed prominently to the outside packaging. If such Product fails to so conform, Collagen will reimburse Technologies for shipment charges for return of the nonconforming Product.
Return of Defective Product. After contacting us and receiving a Return Authorization Number, the user shall promptly return the product to us at the user's expense. Failure to follow this procedure shall render this warranty null and void. Labor Allowance within the Warranty Period If a Lamp and/or Generator fails within the warranty period and was installed and operated as indicated in the Terms and Conditions specified below, a reasonable labor allowance may be available under the following conditions and at the sole discretion of our company. Labor Warranty This warranty covers all labor performed by Pearl Street on any project described in the contract. It ensures that all work is performed in a workmanlike manner and according to industry standards. The warranty period is one year from the installation date. Exclusions: • Materials or products, which may be covered by a manufacturer's warranty • Normal wear and tear • Damage caused by misuse, abuse, or neglect • Alterations or repairs made by parties other than Pearl Street

Return of Defective Product. All defective or nonconforming Product that was rejected shall be returned to SUPPLIER with a copy of the applicable inspection report setting forth in detail all defect(s) or nonconformities for each failed Unit of Product. SUPPLIER may, at its option and expense, re-test the Product determined by VA LINUX and/or its Contract Manufacturer to be defective or nonconforming. If SUPPLIER determines that the Product is not defective or nonconforming, or that the defect is not attributable to SUPPLIER, VA LINUX, VA LINUX's Contract Manufacturer and SUPPLIER shall meet within ten (10) Business Days to resolve the discrepancy.
