Return of PHI. Business Associate agrees that upon termination of this Agreement, and if feasible, Business Associate shall (a) return or destroy all PHI received from, or created or received by Business Associate on behalf of, Covered Entity that Business Associate still maintains in any form and retain no copies of such information or, (b) if such return or destruction is not feasible, extend the protection of this Agreement to such PHI and limit further uses and disclosures to those purposes that make the return or destruction of the PHI infeasible.
Return of PHI. Except as provided in the section below, upon termination of this BA Agreement for any reason, Boston Scientific will return or destroy all PHI received from Provider, or created or received by Boston Scientific on behalf of Provider. This provision will apply to PHI that is in the possession of subcontractors or agents of Boston Scientific.
Return of PHI. Upon termination:
5.3.1 Except as provided in paragraph 5.3.2 of this section, upon termination of this Agreement for any reason, Contractor shall return or destroy all PHI received from Covered Entity or RCEB, or created or received by Contractor on behalf of Covered Entity or RCEB. This provision shall apply to PHI that is in the possession of subcontractors or agents of Contractor. Contractor shall retain no copies of the PHI.
5.3.2 If Contractor determines that returning or destroying the PHI is not feasible or practicable, Contractor shall provide to Covered Entity and RCEB notification of the conditions that make return or destruction impossible or impracticable. Upon such notification, Contractor shall extend the protections of this Agreement to any retained PHI received hereunder and limit any further uses and disclosures to those purposes that make the return or destruction of the information impossible or impracticable for so long as Contractor maintains such PHI.
Return of PHI. Business Associate agrees that upon termination of this Agreement, and if feasible, Business Associate shall, at its election, (a) return or destroy all PHI received from Covered Entity, or created or received by Business Associate on behalf of Covered Entity, that Business Associate maintains in any form or manner and retain no copies of such information or, (b) if such return or destruction is not feasible, immediately notify Covered Entity of the reasons return or destruction are not feasible, and extend indefinitely the protection of this Agreement to such PHI and limit further uses and disclosures to those purposes that make the return or destruction of the PHI not feasible.
Return of PHI. Upon termination of this Agreement, BA shall return all PHI required to be retained by the BA or its subcontractors, employees or agents on behalf of the CE. In the event the BA determines that returning the PHI is not feasible, the BA shall provide the CE with written notification of the conditions that make return not feasible. Additionally, the BA must follow established policies and procedures to ensure PHI is safeguarded and disposed of adequately in accordance with 45 C.F.R. section 164.310, and must submit to the CE a certification of destruction of PHI. For destruction of ePHI, the National Institute of Standards and Technology (NIST) guidelines must be followed. XX further agrees to extend any and all protections, limitations, and restrictions contained in this Agreement, to any PHI retained by BA or its subcontractors, employees or agents after the termination of this Agreement, and to limit any further use, access or disclosures.
Return of PHI. Upon any termination, expiration or non-renewal of this Agreement, Business Associate will return or, at the request and expense of the CSB, destroy any PHI that Business Associate, its agents, or subcontractors then maintains in any form. If, however, Business Associate or the CSB determine that such return or destruction is not feasible, such PHI will not be returned or destroyed and Business Associate will remain bound by the provisions of this Agreement as to such retained PHI until such PHI is returned to the CSB or destroyed.
Return of PHI. Except as provided in Section 15.2 of this Addendum A, upon termination of this Addendum A or the Agreement, for any reason, Business Associate shall return or destroy, without unreasonable delay, all Practice PHI received from Covered Entity, or created or received by Business Associate on behalf of Covered Entity. This provision shall apply to Practice PHI that is in the possession of subcontractors or agents of Business Associate.
Return of PHI. Except as provided in the section below, upon termination of this BA Agreement for any reason, HealthSnap will return or destroy all PHI received from Provider, or created, maintained or received by HealthSnap on behalf of Provider.
Return of PHI. Upon any termination, expiration, or non-renewal of this Agreement, Business Associate will return or, at the request and expense of Fairfax County, destroy any PHI that Business Associate, its agents, or subcontractors then maintains in any form. If, however, Business Associate or the Fairfax County determine that such return or destruction is not feasible, such PHI will not be returned or destroyed and Business Associate will remain bound by the provisions of this Agreement as to such retained PHI until such PHI is returned to Fairfax County or destroyed.
Return of PHI. Within sixty (60) days of termination of this BAA, AUGS shall return or destroy all PHI that AUGS or its Subcontractors maintains in any form and shall retain no copies of such PHI. Such destruction shall render PHI unusable, unreadable, or indecipherable to unauthorized individuals through the use of a technology or methodology specified in guidance issued by the Secretary. If AUGS determines that the return or destruction of PHI is not feasible, the terms of this BAA shall remain in effect for as long as AUGS retains such PHI. Signature Signature By: By: Title: Title: Date: Date: Exhibit B Principal User The “Principal User” for AQUIRE will be an individual selected by the Participant or will be the Participant. The main function of the Principal User is to ensure that patient and program data complies with AQUIRE definitions and security requirements and to act as the main contact between AUGS and the Participant. Specifically, the Principal User will:
1. Participate in at least one AQUIRE training webcast/webinar and/or complete the online training module and any significant updates as determined by AUGS.
2. Ensure that all Participant Data conform to the specific definitions and collection periods as defined by AUGS.
3. Ensure that the Participant utilizes all necessary security precautions to ensure data integrity and security.
4. Ensure that all staff who will or may be entering data into AQUIRE are sufficiently trained to ensure compliance with data validity and security.
5. Act as a contact source between AUGS and the Participant regarding any general AQUIRE communications, updates, troubleshooting, or data inquiries.
6. Notify AUGS staff as soon as possible regarding data entry errors, software problems, bugs, or other problems that would compromise the validity and/or security of the member’s data or of AQUIRE as a whole.
7. Notify AUGS of a change in the Principal User.
