Return Packaging. 5.1. The Buyer commits, in respect to the buyer, to properly package the buyer’s purchased goods (unless the nature of the goods dictates otherwise), and in such a way that if regularly transported they will reach their destination in good condition. 5.2. Return Packaging remains the property of the Buyer and should be returned, paid for its transport, undamaged and in good condition, or be delivered with a next order / load to buyer. The costs and risks of the transport of empty return packaging are for the account of the Seller. 5.3. If empty return packaging has not been returned within two months after the date of delivery by the Seller, and the Seller remains reluctant to return the packaging after a notice and summation, the Buyer holds the right to be compensated for damages, based on the current acquisition cost of the return packaging. 5.4. All return packaging, temporarily made available to the Seller, (whether or not under calculation of a deposit or deposit) is intended solely for the packaging of the Buyer’s goods. 5.5. The return packaging must not be used for any purpose other than for which it is intended. The Seller is not entitled to offer the return packaging of Buyer to third parties. 5.6. Once the returnable packaging is released, the Seller should clean it if it has not been cleaned by Buyer, and store them in accordance with the hygiene requirements of the industry. The costs deriving from this procedure are to be paid by the Seller. 5.7. If the Buyer receives return packaging which is not or not properly cleaned by the Seller, the costs for cleaning must be paid for by the Seller according to the appropriate rate in the industry. To assess whether the returnable packaging is properly cleaned, the requirements of hygiene in the industry are to be held as standard. 5.8. In case of loss of, or damage to, the return packaging, Seller is responsible for returning the packaging in good order or to compensate Buyer for the value of the missing or broken packaging.

Return Packaging. If Customer receives a RMA and wishes to return Equipment, Customer shall re-package the Equipment exactly as received and shall use all original packaging. The original Equipment boxes shall be undamaged and the Equipment shall be returned with all manuals, cables, warranty cards, and any other item included in the original shipment. The RMA number must be visible on all shipping labels and return documents. All returned items must arrive at the address stated on the RMA form within 15 days of the RMA issue date.

  • Salary Packaging (1) For the purposes of this Agreement, salary packaging shall mean an arrangement whereby the wage or salary benefit arising under a contract of employment is reduced, with another or other benefits to the value of the replaced salary being substituted and due to the practitioner. (2) A practitioner may, by agreement with the employer, enter into a salary packaging arrangement. (3) The employer shall not unreasonably withhold agreement to salary packaging on request from a practitioner. (4) The employer shall not require a practitioner to enter into a salary packaging arrangement, provided that this clause will not impinge on any additional employer provided benefits. (5) A salary packaging arrangement shall be formulated and operate on the basis that, on balance, there shall be no material disadvantage to the practitioner concerned, and shall be cost neutral in relation to the total employment cost to the employer. (6) A salary packaging arrangement must comply with relevant taxation laws and the employer shall not be liable for additional tax, penalties or other costs payable or which may become payable by the practitioner. (7) In the event of any increase or additional payments of tax or penalties associated with the employment of the practitioner, or the provision of employer benefits under the salary packaging agreement, such tax, penalties and any other costs shall be borne by the practitioner. (8) A practitioner may elect to cancel any salary packaging arrangement by giving a minimum of four weeks notice. (9) The employer may elect to cancel any salary packaging arrangement by giving a minimum of four weeks notice if the employer incurs a liability to pay fringe benefits tax or any other tax in respect of the non-cash benefits provided, provided that the employer cannot retrospectively cancel any salary packaging arrangement. (10) Notwithstanding subclauses (8) and (9) of this clause, the employer and the Practitioner may agree to forgo the notice period. (11) The cancellation of salary packaging will not cancel or otherwise effect the operation of this Agreement. (12) For the purposes of this provision, any penalty rate, loading or other salary related allowances which would ordinarily be calculated on the basis of the salary rates expressed in Schedule 1 Full Time Annual Base Salary Rates shall continue to be so calculated despite an election to participate in any salary packaging arrangement. (13) For the purposes of this provision, statutory 9% employer superannuation contributions shall be made on the basis of pre-packaging salary rates. To avoid doubt, employer contributions shall not be reduced as a result of a practitioner participating in salary packaging pursuant to this provision. (14) The employer may at any time vary the range of benefits provided or the conditions under which benefits are provided however the employer shall not differentiate between different class of practitioners across WA Health in terms or range of benefits or the conditions under which benefits are provided. (15) If a practitioner is found to have committed misconduct in the claiming a salary packaging benefit the employer is entitled to prospectively cease to provide some or all salary packing benefits either indefinitely or for any period determined by the employer.

  • Packages a. CLIENT has purchased one or more of the following packages (the “Package”) as Full Season, Single Game or Bundled Packages from TAILGATE GUYS as reflected in the order placed with TAILGATE GUYS by CLIENT and incorporated herein by reference upon payment therefore: (i) Varsity (ii) Letterman (iii) All-American (iv) Club b. The Tailgating Services provided by TAILGATE GUYS pursuant to this Agreement may, at the option of CLIENT and subject to availability, include a media package comprised of a television, stand, connection to a satellite, connection to a receiver, and power source (a “Media Package”). CLIENT acknowledges and agrees that TAILGATE GUYS has no control over television broadcasts and shall not be held accountable for any channel “blackouts” caused by contract disputes or any lack of service due to inclement weather or other availability issues. In the event of services issues resulting from setup or technical matters not covered in the aforementioned terms of this paragraph, any refund for services is limited to either the amount separately invoiced or the portion of a tailgate package price related to media package(s) based on TAILGATE GUYS’s current, standard rates for similar service as sold separately to the general public.
