Common use of Returning to work at conclusion of leave Clause in Contracts

Returning to work at conclusion of leave. (a) At least four weeks prior to the expiration of parental leave, the Employee will notify the Employer of their return to work after a period of parental leave. (b) Subject to clause 48.23.2(c), an Employee will be entitled to the position which they held immediately before proceeding on parental leave. In the case of an Employee transferred to a safe job pursuant to clause 48.12 above, the Employee will be entitled to return to the position they held immediately before such transfer. (c) Where such position no longer exists but there are other positions available which the Employee is qualified for and is capable of performing, the Employee will be entitled to a position as nearly comparable in status and pay to that of their former position.

Returning to work at conclusion of leave. (ai) At least four weeks prior to the expiration of parental leave, the Employee employee will notify the Employer TAC of their return to work after a period of parental leave. (bii) Subject to clause 48.23.2(c38.23(b)(iii), an Employee employee will be entitled to the position which they held immediately before proceeding on parental leave. In the case of an Employee employee transferred to a safe job pursuant to clause 48.12 38.12 above, the Employee employee will be entitled to return to the position they held immediately before such transfer. (ciii) Where such position no longer exists but there are other positions available which the Employee employee is qualified for and is capable of performing, the Employee employee will be entitled to a position as nearly comparable in status and pay to that of their former position.

(bii) Subject to clause 48.23.2(c57.30(b)(iii), an Employee will be entitled to the position which they held immediately before proceeding on parental leave. In the case of an Employee transferred to a safe job pursuant to clause 48.12 57.14 above, the Employee will be entitled to return to the position they held immediately before such transfer. (ciii) Where such position no longer exists but there are other positions available which the Employee is qualified for and is capable of performing, the Employee will be entitled to a position as nearly comparable in status and pay to that of their former position.

(c) iii. Where such position no longer exists but there are other positions available which the Employee is qualified for and is capable of performing, the Employee will be entitled to a position as nearly comparable in status and pay to that of their former position.
