Common use of Right to alter Measuring Equipment Clause in Contracts

Right to alter Measuring Equipment. ActewAGL has the right at its discretion, acting reasonably, and at the User's cost: (a) to install flow control mechanisms on the Measuring Equipment at any Delivery Point, allowing ActewAGL to control the amount of Gas withdrawn by the User at that Delivery Point; and (b) alter or make additions to the Measuring Equipment installed at any Delivery Point, where this is required by ActewAGL for the safe and reliable operation of the Network, for the protection of the Network or to ensure the User’s compliance with the provisions of this Agreement. Where the safe and reliable operation or the protection of the Network does not necessitate immediate action, ActewAGL will notify the User of any issue coming within the scope of this clause 16.8 and outline its concern and, where the issue relates to the User's compliance with the provisions of this Agreement, state a reasonable period of time within which the User may rectify the issue before ActewAGL will take action at the User's cost.
