Common use of Right to Return from Leave Clause in Contracts

Right to Return from Leave. When applying for parental leave, the bargaining unit member shall specify the duration of the leave which shall coincide with a school semester. Unless otherwise mutually agreed by the Superintendent and the member, the duration of leave shall not be increased or decreased and the member will return to active employment at the beginning of a school semester; provided, however, that in the event of loss of the child or the unforeseen loss of a majority of the spouse's financial support, the member will be entitled, if he/she desires, and if at least fifteen (15) days advance notice of the intent to return is given to the Superintendent to return to active employment by not later than the beginning of the next grading period. A return to active employment shall be to the same position the member held at the time leave commenced, provided that he/she returns not later than the commencement of the next school year; a return to active employment after that shall be to an equivalent position.
