RIGHTS OF ASSOCIATION. SECTION 1 There shall be no discrimination, interference, restraint, or coercion by the School Committee or the Association or their respective agents against any teacher because of membership or non- membership in or participation in the lawful activities of the Association. Representation by the Association in the capacity of bargaining agent shall be available to all teachers in the unit covered by this Agreement who are eligible for membership. No teacher shall be required to join the Association or to pay a fee or dues as a condition of employment or to obtain such representation. SECTION 2 The Committee agrees that, in accordance with the provisions of Chapter 180, Section 17 (c) of the General Laws of Massachusetts, it will request the Town Treasurer to deduct membership dues from the salaries of its teachers who have voluntarily submitted written authorization in the form set forth below. Dues will be deducted in twenty-six (26) equal payments beginning with the first paycheck in September. Beginning in September 2017, dues will be deducted in twenty-four (24) equal payments beginning with the first paycheck in September. The amount so deducted will be remitted in accordance with such authorization to the Needham Education Association for disbursement to the respective organizations, provided that the Committee shall be under no obligation to make any such deductions after the receipt of a revocation, in accordance with the terms hereof. The Committee will incur no liability for loss of due monies after the Association representative receives said monies in person from the Town Treasurer. To: Needham School Committee Needham, Massachusetts I hereby request and authorize the Needham School Committee to direct the Town Treasurer to deduct from my earnings and transmit to the Associations listed below an amount sufficient to provide for the regular payment of membership dues as certified by each such Association in twenty-six (26) equal payments beginning with the first paycheck in September. Beginning in September 2017, dues will be deducted in twenty-four (24) equal payments beginning with the first paycheck in September. This authorization shall remain in effect (1) until the termination of the Agreement between the Committee and the Association providing for such deductions or (2) my written revocation of this authorization, which shall become effective sixty (60) days after receipt of such revocation by the Superintendent of Schools and the President of the Needham Education Association. Such deductions are to be made each pay period and are to be limited to savings and/or loans to be placed with the credit union(s) named in this Section. SECTION 5 The School Committee accepts the association’s request that effective on the 30th day following the ratification of this agreement and/or after the commencement of employment and/or by December 1 of any school year, whichever is applicable, bargaining unit members shall become members in good standing of the Association. Any bargaining unit member who does not become a member shall be required to pay an agency service fee to the Association, which shall be set by the Association and/or its affiliate organizations (the Massachusetts Teachers Association and the National Education Association), payable upon notice as per the procedures and regulations determined by the Division of Labor Relations Commonwealth Employee Relations Board under its authority pursuant to M.G.L.

RIGHTS OF ASSOCIATION. SECTION 1 There shall be no discrimination, interference, restraint, or coercion by the School Committee or A. Whenever any representative of the Association or their respective agents against any teacher because Employee is mutually scheduled by the parties to participate during working hours in grievance proceedings, conferences, or meetings, said Employee shall be released from regular duty and shall suffer no loss in pay during such grievance proceeding, conference, or meeting. The Association and its representatives shall be allowed the use of membership or non- membership in or participation in school buildings for meetings after school hours according to Board Policy on Use of Facilities. Arrangements for such meetings shall be made with the lawful activities principal of the Associationbuilding in which the meeting is planned, or the building administrator in his absence, and by filing a written facility use request with the Central Administrative Office within forty-eight (48) hours of said use. The Association shall have, in each school building, the capacity use of bargaining agent a bulletin board in each faculty lounge and teacher’s room. D. RIGHTS OF ASSOCIATION. SECTION 1 There A. The Association President or designee shall be no discriminationallowed up to twenty (20) paid hours per workweek to accomplish general Association business as defined in paragraph C.2. below. B. The Association President shall be allowed an additional two hundred (200) hours paid time per contract year to accomplish general Association business as defined in Paragraph C.2. below. The President is permitted at his/her discretion to delegate use of said time to other Association officers to include board members. Additional release time may be approved by the Sheriff on a case-to-case basis. 1. The Association may designate eight (8) local Association representatives in addition to the officers above. The Association shall notify the Sheriff's Office, interferencein writing, restraintof the name of any local Association representative and his/her jurisdictional area as soon as practicable. 2. The Sheriff's Office shall provide the Association representatives reasonable opportunity to utilize the above release time to serve in his/her capacity. The representative may utilize that time to participate in any of the duties arising within his/her jurisdictional area, those duties being defined as: (a) The investigation of a bargaining unit member's grievance or potential grievance; (b) Representation of a member/grievant at any step of the grievance procedure established herein; (c) Consultation with duly accredited representatives of the Association on matters involving the Association's relationship with the County; and (d) Attending County functions/meetings, which have a direct impact on the Association. 3. The representative shall notify his/her immediate Supervisor each time he/she wishes to conduct appropriate business and may be relieved of duty unless operational demands preclude permission to leave the work location being granted. Appropriate use of representative time, as provided herein, shall not be abused by the employee, and use of said time will not be unreasonably withheld by the responsible supervisor. D. For each separate fiscal year covered by the term of this Agreement, the Association will use leave without pay, annual leave, or coercion bonus leave for members to attend meetings, conferences, legislative sessions and conventions or to attend to other Association business, other than that covered in paragraph C.2. of this provision. Per Diem and/or travel shall not be provided by the School Committee Office. The scheduling of time off under this provision requires the advance approval of the Sheriff or his designated representative. E. The County agrees to provide the Association with three (3) areas at Xxxx Boulevard and one (1) area at Incline Substation for the Association to post one (1) bulletin board. Each bulletin board shall not exceed three (3) feet by four (4) feet in area. Materials shall be posted upon bulletin boards specifically as designated, and not on walls, doors, file cabinets or their respective agents against any teacher because other place. The material posted on bulletin boards shall not be obscene, defamatory, derogatory, or of membership a partisan political nature, nor shall it pertain to public issues which do not involve the County or non- membership in or participation in its relationship with the lawful activities Association. All posted material shall bear the identity of the sponsor, shall be signed by a duly appointed representative of the Association, shall be neatly displayed, and shall be removed as soon as no longer timely. F. The County recognizes its statutory obligation to negotiate any departmental rule, policy or procedure that is related to a mandatory subject of bargaining as enumerated under NRS 288.150. In the event there is a dispute over whether a rule, policy or procedure falls within the scope of mandatory bargaining, said dispute shall be submitted to the Local Government Employee-Management Relations Board and shall not be subject to the grievance procedure contained in this Agreement. G. The Sheriff, or his/her designee, and the County Labor Relations Manager shall meet bi-monthly if needed and requested by either party with representatives of the Association for the purpose of engaging in Labor Management meetings. The purpose of said meetings is to informally discuss matters of concern and/or interest to either party. Any Association which will change the rate of its membership dues will give the Committee ninety (90) days' written notice prior to the effective date of such change. SECTION 4 In accordance with the provisions of Section 178B of Chapter 149 of the General Laws, the School Committee will request the Town Treasurer to make payroll deductions for those teachers who so authorize him/her for payments into either the Massachusetts Teachers' Association Credit Union (Century Bank & Trust Company of Medford) or U.S. Trust or Wellesley Municipal Employees Federal Credit Union. Such deductions are to be made each pay period and are to be limited to savings and/or loans to be placed with the credit union(s) named in this Section. Said deductions are to be paid promptly to the Credit Unions. SECTION 5 The School Committee accepts the association’s request that effective on the 30th day following the ratification of this agreement and/or after the commencement of employment and/or by December 1 of any school year, whichever is applicable, bargaining unit members shall become members in good standing of the Association. Any bargaining unit member who does not become a member shall be required to pay an agency service fee to the Association, which shall be set by the Association and/or its affiliate organizations (the Massachusetts Teachers Association and the National Education Association), payable upon notice as per the procedures and regulations determined by the Division of Labor Relations Commonwealth Employee Relations Board under its authority pursuant to M.G.L.
