RIGHTS OF ASSOCIATION. Section 3.1 Section 3.2 The Board specifically recognizes the right of its employees appropriately to invoke the assistance of the Michigan Employment Relations Commission, or a mediator from such public agency, or an arbitrator appointed pursuant to the provision of the Agreement. Section 3.4 The Board agrees to furnish to the Association, in response to reasonable requests from time to time, available information concerning the financial resources of the District and such other information as will assist the Association in developing intelligent, accurate, informed and constructive programs on behalf of its members together with information which may be necessary for the Association to process any grievance or complaints. Section 3.5 It is agreed and recognized, however, that except for expenditures contained in any annual budget which are required by the terms of this Agreement, the authority to adopt all parts of the annual budget of the School District resides exclusively with the Board and during the term of this Agreement shall not be the subject of mandatory negotiation with the Association, nor subject to any proceeding under the grievance procedure. Section 3.6 Any member of the Bargaining Unit engaged during the working day in any negotiation session or LMC meeting shall be released from their regular duties without loss of pay or benefits. To the extent that work schedule adjustments are agreed to between the Association President and the Director of Facilities, and to the extent that work schedule adjustments may be made without incurring a contractual, legal, or statutory requirement for overtime compensation, the Association President shall be permitted to adjust the work day and work week to conduct Association business when necessary. Other officers of the bargaining unit must receive prior approval from the Director of Facilities before being released from their work assignment to conduct Association business during work hours.

RIGHTS OF ASSOCIATION. Section 3.1A. For the purposes of this Article, and except as otherwise provided herein, Association representatives will be limited to Association officers, building representatives and committee chairpersons who are bargaining unit members.
Section 3.2 The Board specifically recognizes B. The Association will be financially liable for any damage to, or loss of, the equipment when such damage or loss results from the Association's unreasonable, improper, or negligent use of it; and the Association will reimburse the board for the cost of supplies used.
E. The Board will provide the Association with bulletin board space. The representatives of the Association will have the right to post notices of its activities and matters of concern on such bulletin board space; however, the space may not be used to post partisan political material or material defamatory of the Board or its administration.
F. Association representatives will have the right to use the school district's mailboxes.
G. At the conclusion of staff meetings, subject Association representatives may make announcements pertaining to Association business.
H. The Association president or his/her designee will be notified in advance of the time, date, and place of all board meetings and will receive a copy of the full agenda, excluding all material which is confidential and not a matter of public record, for each Board meeting with, or as soon as possible after, notification.
I. The Association President or his/her designee will be provided copies at the Association's expense of the following district available information when such information is requested in connection with collective bargaining in Article 2:
1. A copy of the training and experience grids for bargaining unit members
2. Bargaining unit members paid on any other supplemental, extended service or special hourly rate.
J. Association business will be conducted outside of regular working hours. However, if both the representatives of the Board and the representatives of the Association agree to meet during working hours, the representatives will be paid.
K. Bargaining unit members may authorize the Board to make payroll deductions for membership dues, initiation fees, and assessments of the Association as follows:
1. The Association will submit a written authorization signed by the unit member for payroll deduction on a form provided by the Association to the scheduling by AdministrationBoard's Treasurer on or before October 20, of any year the unit member begins payroll deduction under this section. No employee shall Unless revoked or changed in keeping with procedures contained herein, an authorization will continue from year to year. In the event a refund is due a unit member, it will be prevented from wearing insignia, pins or other identification the responsibility of membership in the Association either on or off school premisesto make such a refund.
2. Bulletin boardsExcept as provided for below, school mail, and other established media of communication shall authorized payroll deductions will be made available in equal installments from each paycheck beginning with the first pay in November.
3. If unit member's employment ends, or if he/she goes on an unpaid status before all deductions have been made, the unpaid balance will be deducted from his/her final payroll check. If a unit member revokes his/her authorization before all deductions have been made, the unpaid balance will be deducted from his/her next payroll check after the Board's Treasurer receives notification of such revocation.
4. Any such authorization revocation must be made in writing and in duplicate. It must be submitted to the Board's Treasurer and to the President of the Association.
5. Following the completion of deductions from each payroll, the Board's Treasurer will remit the amount which was deducted to the Association treasurer at his/her home address in check form made payable to "The Delaware Area Career Center Education Association."
6. The Association will provide the Board's Treasurer a list of those unit members who authorized payroll deduction, the amount to be deducted for each unit member, and its members.

The Association shall have the right to reasonable use school building facilities of the District mail service, Unit Member mailboxes, and the District email service for communications to Unit Members. A copy of any communication delivered to non-Association Unit Members shall be at all reasonable hours for meetings, subject the same time provided to the scheduling by Administration. No employee shall be prevented from wearing insignia, pins or other identification The Association acknowledges that its Unit Members have no reasonable expectation of membership privacy in the use of the District’s email service and that nothing in this Agreement alters the application of Board Policy 7540.01 and 7540.04, as amended from time to time.
D. Association either members and their representatives shall have the right to transact official Association business on school property at reasonable times, provided that this shall not interfere with or off interrupt normal school premises. The Board agrees to furnish to the Association, in response to reasonable requests from time to time, available all regularly and routinely prepared information concerning the financial resources of the District including but not limited to annual financial reports and such other information as will assist the Association in developing intelligentaudits, accurateregister of unit member licensed personnel, informed tentative budgetary requirements and constructive programs on behalf allocations, agenda and public minutes of its members together with information which may be all board meetings, treasurer’s reports, provided it is necessary for the Association to process any grievance or complaintscomplaint, prepare for negotiations or otherwise exercise rights available to the Association. The Association agrees to first access such records and information from the District’s website to the extent available there. As appropriate, and in a timely manner, the District will advise the Association President or his/her designee, of any emergency or environmental conditions which may disrupt the educational process or impact the working conditions of any bargaining unit member. Nothing herein shall require the Central Office administrative staff to research and assemble information for the Association.

RIGHTS OF ASSOCIATION. Section 3.13.1 The Committee recognizes the desire of the teachers to participate in the planning of all aspects of the school and its operation. Written requests by the Association for inclusion of items on the agenda of any School Committee meeting will be welcome provided that said written request is presented to the Superintendent of Schools at least five (5) school days in advance of said meeting.
Section 3.2 The Board specifically recognizes Committee and the right Association agree to the establishment of its employees appropriately an Educational Council, the purpose of which will be to invoke discuss matters that affect the assistance education of students. 3.4 There shall be at least one (1) bulletin board in each school building for the exclusive use of the AgreementAssociation for the purpose of posting Association material.
Section 3.3 The 3.5 Each year at least thirty (30) days prior to the adoption of the school calendar for the following year, the President of the Association and its members will be given a copy of the proposed calendar. If the Association does not agree with the proposed calendar, it may submit recommended changes to the School Committee, which will consider the recommendations prior to final adoption of the calendar by the School Committee.
3.6 Upon retirement a member of the bargaining unit shall continue to have access to his/her employee email address, pending he/she signing the acceptable use policy every year. Said retiree will lose the right to use school building facilities keep the email address for failure to abide the rules or lack of a yearly signature on the policy.
3.7 The Committee shall afford the Association the opportunity to meet with new employees on the day of their orientation at all reasonable hours for a time agreeable to the Parties.
3.8 The Committee shall provide, upon being hired or at other times at the request of the Association an employee's address and contact information.
3.9 The Committee shall organize the first day professional development day, prior to the start of school, in the following manner: 7:30-8:30 School based meetings, subject to the scheduling by Administration8:30-10:00 District based meeting.
