RIGHTS OF THE TEACHER. A. The Board recognizes its responsibility to continue to give reasonable support and assistance to all teachers with respect to the maintenance of control and discipline in the classroom. B. The Board shall provide special education programs as mandated by Department of Education guidelines. C. Any assault by a child upon a teacher shall be promptly reported to his immediate supervisor. In the event of such an assault, or if a teacher is complained against or threatened with civil action by reason of disciplinary action taken against a student, which is not inconsistent with the provisions of section D below, the teacher involved may, through the Association, request assistance from the Board in such matter, and the Board shall provide such legal counsel. If it is ultimately determined that the teacher is found innocent, or has acted appropriately, or a mutual settlement has been agreed upon; the Board shall pay the legal fees for the teacher which are not otherwise covered. D. The Association agrees that all teachers shall observe rules respecting punishment of students as established by the Board or required by state law.
