Risk of Loss or Damage; Maintenance and Repair of Work. 10.3.1 DB Contractor shall be responsible for maintenance with respect to each Location in accordance with the Technical Provisions. This maintenance obligation shall begin upon the commencement of Construction Work for each Location. Upon Substantial Completion of each Location, TxDOT shall assume the maintenance obligations for each such Location, and DB Contractor shall be relieved from responsibility for maintenance of such portions of the Project; provided, however, that DB Contractor shall be responsible for maintenance of improvements owned by third parties until control of and maintenance responsibility for such improvements has been formally transferred to the third parties.
