Royalty Payable In Kind. Grantee may elect to receive its Royalty on Royalty Gold from the Properties “in cash” or “in kind” as refined bullion from Beneficiated Royalty Gold (“Refined Bullion”). Grantee may make such election only once per year, on a calendar year basis. Grantee shall give written Notice of election to receive the Royalty payable in any calendar year in cash or in kind to Grantor on or before November 1 of the immediately preceding calendar year. If Grantee fails timely to make such election for any calendar year, the Royalty payable in such calendar year shall be payable in the same manner as it was payable in the immediately preceding calendar year. As of the Effective Date, Grantee elects to receive the Royalty in cash.
