SAFETY, SANITATION AND SHELTER. 9.01 Every Employer shall provide a proper and adequate place of shelter sufficiently heated and securely locked in which the employees may eat their lunch and store their clothing. It is further agreed that the lunch room facilities shall be separated by a partition from the area in which the clothing is stored. Water, towels and soap shall be available at all times. It is clearly understood that the place of shelter shall not be used for any other purpose, such as storage of tools, etc. Sanitary toilets shall be provided in accordance with the regulations of the Occupational Health and Safety Act, as amended, and if located near the lunch room shall be separated by a partition. The Employers agree to provide the above facilities before production work commences on the project. It is agreed that these facilities shall be on or in the vicinity of the working area. Without in any way limiting the generality of the above, in the case of welders, employed by the Employer, the special clothing and protective equipment which the Employer is required to supply shall include the following: Suitable gloves for welding, leather sleeved or welding jackets, safety helmets and welding masks, cutting goggles and all equipment required for normal welding duties. 9.02 In cooperation with the Employer’s overall program of Accident Control and Prevention, the Job Xxxxxxx and Health & Safety Representative may report to the Xxxxxxx for immediate corrective action of any unsafe conditions, unsafe acts or violation of safety regulations. Safe working conditions are primarily the responsibility of Management; therefore, all supervisory personnel shall be made aware of all safety regulations and see that they are carried out. 9.03 Every employee shall, as a condition of employment, be required to wear a Safety Helmet of an approved type. The Employers agree said helmets will be supplied by them at no cost to the 68 Provincial Civil Agreement employee. If an employee at termination of employment does not return said helmet, he/she shall be charged at cost. 9.04 Every employee shall, as a condition of employment, own and wear suitable protective footwear. The Employer shall supply protective equipment required in the normal course of the employee’s duties including special clothing such as suitable gloves, at no cost to the employee. The Employer shall provide leather safety boots to the employees covered by this Appendix, at cost, which will be deducted from the employee’s pay. It is further agreed that the Employer shall provide free of cost, rubber safety boots when necessary. The Union recognizes the right of the Employer to economically supervise the distribution of clothing provided and will co-operate with the Employers to prevent wasteful practices. 9.05 A Safety Committee is to be established. This Committee will be composed of two (2) members of the Union, and two (2) representatives from the Employer. Safety meetings, not to exceed one (1) per month, will be held and may be called by either party. A Safety Committee may be established by the Union on projects with twenty (20) employees or more coming within the jurisdiction of this Appendix, provided that there is no more than one (1) committee per project. 9.06 The Employer shall, at his own expense, furnish to any xxxxxxx injured in his/her employment who is in need of it, immediate conveyance and transportation to a hospital or to a physician. It is further agreed that an ambulance shall be used where necessary and possible. 9.07 An employee who is injured during working hours and who is required to leave for treatment, or is sent home for such injury, shall receive payment for the remainder of the shift at his regular rate of pay. 9.08 Locktenders’ shift reports will be kept in ink. 9.09 The trucks to be used to transport employees will be enclosed and tools will be secured in toolboxes. No materials will be carried in the trucks in a manner endangering the safety of the employees being transported. Provincial Civil Agreement 69 9.10 No employee will be discharged by his/her Employer because he/ she fails to work in unsafe conditions as set out in government safety regulations. Any refusal by an employee to abide by such regulations after being duly warned, will be sufficient cause for dismissal. 9.11 On projects where the Employer is required under Article 9.01 to provide locked up facilities for employees to store their tools and clothing, the Employer will reimburse an employee up to three hundred and fifty dollars ($350.00) for loss due to fire or theft resulting from a break-in to such locked-up facilities. In all cases, the employee must provide a written and signed statement substantiating the amount of the loss. 9.12 Each member shall be required to carry and present to his employer on attending at the jobsite a Health and Safety Training Record indicating the training he has received. 9.13 No entertainment devices- such as cell phones, blackberries, iPods, and/or similar devices, shall be used during working hours, nor shall they be turned on, except during lunch breaks, regular work breaks, job site emergencies, or where prior approval is obtained from the employee’s supervisor.

SAFETY, SANITATION AND SHELTER. 9.01 18.01 In co-operation with the Employer's overall program of accident control and prevention, it is expected that an employee will report to the xxxxxxx or if the xxxxxxx is not available, to any person responsible for management of the site, for immediate corrective action, any unsafe conditions, unsafe acts or violation of the Occupational Health and Safety Act. 18.02 Every employee shall, as a condition of employment, be required to own and wear a safety helmet of a type approved by the Canada Standards Association and the Employer agrees said helmets may be purchased from him at cost. When work is to be performed closer than is stipulated as a safe distance to any electrical conductor that is capable of the equipment used during working hoursby the appropriate safety legislation, nor Act or Code, then an assurance in writing that such procedure is safe shall they be turned on, except during lunch breaks, regular work breaks, obtained and signed by the person or persons controlling the system. The Employer shall provide adequate sanitary facilities on the job site emergenciescommensurate with the number of men employed as set out in Municipal, Provincial and Federal Government Statutes and Regulations. Safe working conditions are primarily the responsibility of Management; therefore, all supervisory personnel shall be made aware of all safety regulations and see that they are carried out. 9.03 Every employee shall, as a condition of employment, be required to wear a Safety Helmet of an approved type. The Employers agree said helmets will be supplied by them at no cost to the 68 Provincial Civil Agreement employee. If an any employee at termination of the terminationof employment does not return said helmet, he/she he shall be charged at cost. 9.04 Every employee shall, as a condition of employment, own and wear suitable protective footwear. The Employer shall supply protective equipment required in the normal course of the employee’s duties including special clothing such as suitable gloves, at no cost to the employee. The Employer shall provide leather safety boots to the employees covered by this Appendix, at cost, which will can be deducted from his last pay cheque. If the employee’s payhelmet is returned and has been made unwearable through wilful neglect and abuse, the employee shall be charged for the full replacement value. It is further agreed that the Employer shall provide free of cost, rubber safety boots when necessary. The Union recognizes the right of the Employer to economically supervise the distribution of clothing drinking water and individual cups will be provided and will co-operate with the Employers to prevent wasteful practices. 9.05 A Safety Committee is for employees on all jobs to be establishedused during their breaks and at other times at the Employer's discretion. No materials will be carried in the trucks in a manner endangering the safety of the employees being transported.
