SAFETY, SANITATION AND SHELTER. 7.01 Adequately heated enclosures or cabs for employees for protection from severe weather elements shall be provided by the Employer where reasonably required. 7.02 The Employer shall provide Employees with all Personal Protective Equipment (PPE) excluding safety boots, which is required for the job, such as sandblasting, coating, etc. or during inclement weather. The Employer shall ensure that all PPE is correctly sized for each employee. The Employer shall undertake the maintenance of all PPE which include the Employer’s obligation to launder, at the Employer’s expense, all Employer provided flame resistance/fire retardant coveralls. 7.03 The Employer, the employees, the Local Unions and the Union agree to abide by all of the applicable codes of the Canadian Standards Association relating to workplace safety. 7.04 The Employer agrees to abide by the applicable Occupational Health and Safety Act of the Province in which the work is being performed and any regulations applicable thereto as amended from time to time. Employees shall be allowed one coffee break in each half of the working shift. 7.05 The Employer shall provide iced drinking water in approved sanitary containers and paper cups where no running tap water is available. 7.06 When an employee is injured at work in the course of performing his/her duties and the injury requires medical attention beyond first aid, the Employer will arrange for such treatment and provide transportation to that treatment. If the worker is deemed to be unable to return to work that day by the medical professional, the Employer will provide transportation for that worker to a safe location where he/she can spend the remainder of the day recovering. The worker will be paid for the entire day for the hours normally worked. In addition, when a worker is injured on the job and he/she requires attention beyond first aid, the Employer will inform the union of the injury as soon as they are aware of the requirement for additional medical attention beyond first aid.

Where filtered air systems are required due to environmental conditions, the employer will provide use of respiratory protective equipment including powered air respirator (PAPR) apparatus, excluding helmets, made available for welders only; ancillary workers (UA helpers, IUOE and LiUNA, & Teamsters.) will be provided appropriate respiratory protection equipment including: half-face or full- face air purifying respirator by the employer when required and suitable to environmental conditions, in accordance with employer’s safety assessment and oversight control measures. 7.03 The Employer, the employees, the Local Unions and the Union agree to abide by all of the applicable codes of the Canadian Standards Association relating to workplace safety. 7.04 The Employer agrees to abide by the applicable Occupational Health and Safety Act of the Province in which the work is being performed and any regulations applicable thereto as amended from time to time. The Employer shall undertake the maintenance of all PPE which include the Employer’s obligation to launder, at the Employer’s expense, all Employer provided flame resistance/fire retardant coveralls. 7.03 The Employer, the employees, the Local Unions and the Union agree to abide by all provisions of the applicable codes of the Canadian Standards Association relating to workplace safety. 7.04 The Employer agrees to abide by the applicable Occupational Health and Safety Act of Ontario. The facilities referred to herein will be provided before production work commences on the Province in which the work is being performed and any regulations applicable thereto as amended from time to time. Employees shall be allowed one coffee break in each half of the working shiftjob. 7.05 12.02 The Employer shall provide iced supply safety helmets to employees at no cost. If an employee on termination of employment does not return said helmet, he shall be charged at cost. If the helmet is returned and has been made unwearable through willful neglect and abuse, the employee shall be charged for the full replacement value. 12.03 It is further agreed that drinking water in approved sanitary containers and paper cups will be provided for employees on all jobs and that washing water will be provided where no running tap water outlets are available to the Employer. Further, if a trailer is availableused at the job site for storage of tools and equipment, in addition to use as lunchroom facilities (heated when necessary), the tool storage area will be partitioned off. 7.06 12.04 A Safety Committee is to be established and composed of two (2) members of the Council and two (2) representatives of the Association. Meetings, not to exceed one (1) per month, will be held when requested by either party. 12.05 When an employee is injured at work employees are required to perform their duties in the course of performing his/her duties and the injury requires medical attention beyond first aidwet weather, the Employer agrees to supply suitable protective clothing, including rubber boots and rain suits, which will arrange for such treatment be returned to the xxxxxxx when the assigned duties are completed. It is understood that this provision does not apply to employees who are required to wear rubber boots in the normal course of their duties. 12.06 The Employer shall, at his own expense, furnish to any employee injured in his employment, who is in need of it, immediate conveyance and provide transportation to that treatment. If the worker is deemed to be unable to return to work that day by the medical professional, the Employer will provide transportation for that worker a hospital or to a safe location physician. It is further agreed that an ambulance shall be used where he/she can spend necessary and possible. 12.07 An employee who is injured during working hours in a compensable accident and is required to leave for treatment or is sent home because of such injury shall receive payment for the remainder of the day recovering. shift at his regular rate of pay. 12.08 The worker trucks to be used to transport employees will be paid covered and tools will be secured in tool boxes. No materials will be carried in the trucks in a manner endangering the safety of the employees being transported. 12.09 No employee will be discharged by his Employer because he fails to work in unsafe conditions contrary to the provisions of the Occupational Health and Safety Act of Ontario. Any refusal by an employee to abide by such regulations after being duly warned will be sufficient cause for dismissal. 12.10 On projects where the entire day Employer provides locked-up facilities as required under Article 12.01 for the hours normally worked. In addition, when a worker is injured on the job employees to store their tools and he/she requires attention beyond first aid, clothing the Employer will inform reimburse an employee for up to three hundred dollars ($300.00) for loss due to fire or theft resulting from a break-in to such locked-up facilities. To be eligible for such reimbursement an employee must have Employer approval for the union of tools and clothing that will be placed in such facilities. 12.11 No entertainment devices—such as cell phones, blackberries, iPods, and/or similar devices, shall be used during working hours, nor shall they be turned on, except during lunch breaks, regular work breaks, job site emergencies, or where prior approval is obtained from the injury as soon as they are aware of the requirement for additional medical attention beyond first aidemployee’s supervisor.
