Common use of Satisfaction Guarantee Clause in Contracts

Satisfaction Guarantee. The Breeder guarantees that the Buyer will be satisfied with the dog purchased. If the Buyer is not satisfied with the dog received, the dog may be returned to the Breeder at the Buyer’s expense. The Breeder will replace the dog at a later date or refund the full purchase price, less the deposit. The satisfaction guarantee is valid for 72 hours after the buyer receives the dog. The Breeder guarantees that the dog received is a purebred English Springer Spaniel of sound body, health, and temperament. The dog has been examined by a veterinarian, dewormed, and vaccinated according to the program adapted to the age of the dog. The Buyer is advised to have the dog examined by his/her veterinarian within three days of leaving the Breeder. Failure to do so will result in cancellation of this agreement. You will receive a replacement dog, if the dog is found to have any congenital defect (inherited medical condition that occurs at or before birth) which results in death or veterinarian recommended euthanasia within one year of the sale. I do not guarantee umbilical hernias, undescended testicles, cherry eye, over bite or under bite and dew-claw regrowth. The Breeder must be provided with a written report of the dog’s condition from a licensed veterinarian. The Buyer assumes full responsibility of all costs and care during this time. It is up to the buyer to provide any and all veterinary care, vaccinations and workings for puppy after purchase to guarantee the health of the puppy/dog. I will not guarantee said puppy/dog without proper proof of veterinarian care.

Hip Guarantee: Within one year of the birth date, should the dog develop hip dysplasia or any genetic skeletal disorder you shall notify us within 10 days of diagnose, upon receipt of (1) a letter from a licensed veterinarian attesting to such condition with copies of x-rays, (2) a copy of the OFA (or PennHIP) evaluation report, (3) a spay/neuter certificate, and (4) the AKC registration certificate on such dog, you will receive a replacement dog from the next available litter. We do not guarantee this if the said puppy had been breed before the age of two years old or if the dog has not had proper up-to-date veterinary care.
