School Performance Framework. a. The AUTHORIZER has developed Academic and Operational scorecards to measure the CHARTER SCHOOL’s performance. The scorecards shall collectively constitute the AUTHORIZER’s School Performance Framework (hereinafter, the “FRAMEWORK”), which is attached hereto as Exhibit B and incorporated into this Agreement by reference. The CHARTER SCHOOL shall annually Meet Expectations on the FRAMEWORK. The FRAMEWORK shall supersede and replace any and all assessment measures, educational goals and objectives, financial operations metrics, and organizational performance metrics set forth in the Application and not explicitly incorporated into the FRAMEWORK. The specific terms, form and requirements of the FRAMEWORK, including any required indicators, measures, metrics, and targets, are determined by the AUTHORIZER and will be binding on the CHARTER SCHOOL. b. The AUTHORIZER shall monitor and periodically report on the CHARTER SCHOOL’s progress in relation to the indicators, measures, metrics and targets set out in the FRAMEWORK. Such reporting shall take place at least annually. c. The CHARTER SCHOOL’s performance in relation to the indicators, measures, metrics and targets set forth in the FRAMEWORK shall provide the basis upon which the AUTHORIZER will decide whether to renew the CHARTER SCHOOL at the end of the Charter term or upon the 5-year review. d. The Parties intend that, where this Charter references or is contingent upon state or federal accountability laws, that the CHARTER SCHOOL be bound by any applicable laws, or modification or amendments to such laws, upon the effective date of said laws, or any modifications or amendments thereto. The specific terms, form and requirements of the FRAMEWORK may be modified or amended to the extent required to align with changes to applicable state or federal accountability requirements, as set forth in law. In the event that any such modifications or amendments are required, the AUTHRIZER will use its best efforts to apply such expectations for charter school performance in a manner consistent with those set forth in the FRAMEWORK initially established in the Charter. e. In addition to any requirements set forth in the FRAMEWORK, AUTHORIZER may designate an AUTHORIZER representative or representatives to enter the premises of CHARTER SCHOOL during or outside of school hours, on a scheduled or unscheduled basis, to monitor whether SPONSOR is operating CHARTER SCHOOL in compliance with applicable law and with the terms and conditions of this Agreement and to perform any other of AUTHORIZER’s responsibilities under this Agreement. This AUTHORIZER representative or representatives shall also have the authority set forth above during any period that a FRAMEWORK is not in effect, and the authority to use the information required herein to evaluate CHARTER SCHOOL during any period that a FRAMEWORK is not in effect. To the extent permitted under applicable law, SPONSOR shall maintain the following information at CHARTER SCHOOL and make such information available to AUTHORIZER or its representative upon request no later than two (2) business days, unless otherwise agreed upon in writing, following such request; or, if the information has not yet been disclosed by a third party to SPONSOR or CHARTER SCHOOL, as soon as practicable upon receipt from the third party with the exercise of due diligence on the part of SPONSOR: (1) the SPONSOR’s Articles of Incorporation; (2) the SPONSOR’s bylaws; (3) the enrollment and admissions process for CHARTER SCHOOL; (4) a list of all formerly and currently enrolled students and, for each student, the following information: full legal name, social security number, student identification number (for purposes of state testing), birth date, address, local school district in which the student resides, names and address of legal guardians; required documentation relevant to the student’s special needs status (if applicable); results on assessments required by applicable law, the Application, the FRAMEWORK, and documentation of a student’s suspension or expulsion (if applicable); (5) list of all former and current staff members and teachers CHARTER SCHOOL employs and, for each one, the following information: name, social security number, birth date, address, compensation, evidence of certification to teach or progress toward certification to teach (if applicable); (6) evidence of insurance; (7) leases; (8) documentation of loans and other debt related to CHARTER SCHOOL; (9) detailed accounting of school expenditures and sources of income received that are current through the preceding month, within twenty (20) days after the last day of such month; and
