Scope of Limited Warranty. Fujitsu warrants to you that for a period of ninety (90) days (“Warranty Period”) from delivery of the Software, the Software (other than open source software components as stated in Section 1(d), if any), as delivered, will perform substantially in accordance with the Documentation for the Software.

Scope of Limited Warranty. Confluent warrants to Customer that for a period of thirty (30) days after the first delivery of the Confluent Software by Confluent to Customer, the Confluent Software in the form delivered by Confluent to Customer, will perform substantially in accordance with the written documentation therefor. This limited warranty shall not apply if the Confluent Software has been: (i) altered or modified; (ii) subjected to negligence, computer or electrical malfunction; or (iii) used, adjusted, installed or operated (A) other than in accordance with this Agreement or the instructions furnished by Confluent or (B) with an application or in an environment other than that intended or recommended by Confluent.
Scope of Limited Warranty. The Limited Warranty covers failure of the unit of Silhouette Hardware due to manufacturing error or component failure, but expressly excludes any damage or failure that could reasonably be considered to result from: (i) negligence or misuse of the unit of Silhouette Hardware, including dropping of the unit of Silhouette Hardware, (ii) improper operation, use, storage, repair or maintenance of the unit of Silhouette Hardware, (iii) any modification to the unit of Silhouette Hardware not performed by us, or (iv) connection of the unit of Silhouette Hardware to other equipment or software to which it is incompatible. All other representations or warranties (statutory, express or implied except any which may not lawfully be excluded) with respect to the Silhouette Hardware are expressly excluded. Without prejudice to the generality of the foregoing, the implied warranties of merchantability and fitness for a particular purpose are excluded. We will not be liable to you under the law of tort, contract or otherwise for any direct, indirect or consequential loss or damage, including any loss of profits, however caused, arising out of the use of, loss of use of or disrepair of the Silhouette Hardware. If any limitation of liability is invalid for any reason and we become liable for loss or damage that would otherwise have been excluded, such liability to You for all damages will not (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty US Dollars (US$50.00).
Scope of Limited Warranty. Company warrants to Licensee that during the Term, the Platform will perform substantially in accordance with the terms of Company’s Documentation. Scope of Limited Warranty. Apantac warrants to the original purchaser (usually pursuant to a Reseller Agreement) and to the first end user of the products (the “Product”) manufactured or sold by Apantac, but not to any subsequent owner. Tahoma (“Tahoma”) and Crescent (“Crescent”) Products will be free from defects in material and workmanship for a period of three (3) years from the date of shipment of the Tahoma and Crescent Product to the purchaser. openGear Products (“openGear”) will be free from defects in material and workmanship for a period of five (5) years from the date of shipment of the openGear Product to the purchaser. Mount Hood (“Mt Hood”) and Mazama (“Mazama”) Products will be free from defects in material and workmanship for a period of one (1) year from the date of shipment of the Mt Hood and Mazama Product to the purchaser. Apantac warrants that all repairs of Products not covered by this Limited Warranty shall be free from defects in material and workmanship for a period of ninety (90) days from the date of repair, if done at the customer’s location, or ninety (90) days from the date of shipment of the repaired Product, if done at a different location. In order to obtain service under this warranty, customer must notify Apantac of the defect before expiration of the warranty period and make suitable arrangements for the performance of service. Return authorization numbers are only valid for two (2) weeks once the number has been issued. Customer shall be responsible for packaging and shipping the defective product to the service center designated by Apantac, with shipping charges prepaid. Apantac shall pay for the return of the product to the customer if the shipment is within the country which the Apantac service center is located. Customer shall be responsible for payment of all shipping charges, duties, taxes and any other charges for products returned to any other locations APANTAC MAKES NO OTHER REPRESENTATIONS OR WARRANTIES CONCERNING THE PRODUCTS AND EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EXCEPT FOR THE LIMITED WARRANTY PROVIDED HEREIN, ALL SALES ARE AS IS AND WITH ALL FAULT. THERE ARE NO WARRANTIES OTHER THAN THIS LIMITED WARRANTY THAT EXTEND BEYOND THE DESCRIPTION OF THE PRODUCTS BEING SOLD.
Scope of Limited Warranty. TZ warrants the Product (excepting the software that operates the Product) against defects in materials and workmanship under normal use for a period of one (1) year from the date of acceptance of the Product by the Customer in writing (“Warranty Period”).
