SCPFC and Developer Occupant. SCPFC and Developer Occupant each acknowledges and agrees that upon Closing, the City will sell and convey to SCPFC and SCPFC shall accept the Property “AS-IS, WHERE-IS, WITH ALL FAULTS,” except to the extent expressly provided otherwise in this Agreement and any document executed by the City and delivered to SCPFC at Closing. Except as expressly set forth in this Agreement, SCPFC and Developer Occupant have not relied and will not rely on, and the City has not made and is not liable for or bound by, any express or implied warranties, guarantees, statements, representations or information pertaining to the Property or relating thereto (including specifically, without limitation, Property information packages distributed with respect to the Property) made or furnished by the City, or any property manager, real estate broker, agent or third party representing or purporting to represent the City, to whomever made or given, directly or indirectly, orally or in writing. By becoming the Developer Occupant, the Developer Occupant represents that it is relying solely on its own expertise and that of Greystar’s consultants in purchasing the Property and shall make an independent verification of the accuracy of any documents and information provided by the City. Developer Occupant will conduct or rely on such inspections and investigations of the Property as Developer Occupant deems necessary, including, the physical and environmental conditions thereof, and shall rely upon same. Developer Occupant acknowledges that the City has afforded Developer Occupant and Greystar, upon whose investigations Developer Occupant is relying with Greystar’s permission, a full opportunity to conduct such investigations of the Property as Developer Occupant deemed necessary to satisfy itself as to the condition of the Property and will rely solely upon same and not upon any information provided by or on behalf of the City or its agents or employees with respect thereto, other than such representations, warranties and covenants of the City as are expressly set forth in this Agreement. Upon Closing, Developer Occupant shall assume the risk that adverse matters, including, adverse physical or construction defects or adverse environmental, health or safety conditions, may not have been revealed by Greystar’s inspections and investigations.   • Owner Occupancy Participant(s) agree to maintain the property as their primary residence during the term of this Agreement, any extensions thereof, or until closeout, documentation is approved by NCORR. If during the term of the Grant Agreement, Participant(s) (1) use the property as an investment property (2) convert the structure to an ineligible structure type or use, or (3) uses the property as a recreational house or “second” home, then NCORR may require immediate payment in full of the entire grant amount provided to the Participant(s). Participant(s) agree that if during the term of this Agreement, any extensions thereof or prior to closeout, Participant(s) sell part or all of the property without NCORR’s prior written consent, then NCORR may require payment in full the amount of the Grant outstanding at the time of sale.

  • Period of Occupancy The student may occupy an assigned room at the time specified by the university each semester. If the student fails to occupy the room by 5:00 p.m. on the first day of classes, the university reserves the right to reassign the space or initiate a contract cancellation. However, failure to occupy an assigned space does not automatically release the student from contractual obligation. Occupancy of the room must be relinquished at the completion of the contract. University housing facilities are closed during the periods between semesters, the Thanksgiving holiday and spring break. Residents who are not graduating are required to check out of their residence halls within 24 hours after their last exam but no later than 5:00p.m. on the last day of the exam schedule.

  • Licence to Occupy Premises A5.1 Any land or Premises made available to the Contractor by the Authority in connection with the Contract, shall be made available to the Contractor on a non-exclusive licence basis free of charge and shall be used by the Contractor solely for the purpose of performing its obligations under the Contract. The Contractor shall have the use of such land or Premises as licensee and shall vacate the same on completion, termination or abandonment of the Contract.

  • Physical/Occupational Therapy This plan covers physical and occupational therapy when: • ordered by a physician; • received from a licensed physical or occupational therapist; • a program is implemented to provide habilitative or rehabilitative services. See Autism Services when physical therapy and occupational therapy services are rendered as part of the treatment of autism spectrum disorder. The amount you pay and any benefit limit will be the same whether the services are provided for habilitative or rehabilitative purposes.

  • LICENCE TO OCCUPY 5. The University permits You and Your Permitted Occupiers to occupy the Accommodation and to use the furniture and furnishings within it until this agreement ends. You have permission to use the facilities and communal areas of the Hall in common with the University and the other students of the University until this agreement ends.

If any Tenant, guest, or Occupant(s) violates this Agreement, the Tenant is considered to have violated this Agreement. Landlord’s requests and notices to the Tenant or any of the Occupant(s) of legal age constitutes notice to the Tenant. Notices and requests from the Tenant or any one of the Occupant(s) (including repair requests and entry permissions) constitutes notice from the Tenant. In eviction suits, the Tenant is considered the agent of the Premise for the service of process.

  • NUMBER OF OCCUPANTS Tenant agrees that the House shall be occupied by no more than [Total Number of Occupants] persons, including no more than [Maximum Number of Children] under the age of eighteen (18) years, without the prior written consent of Landlord.

  • Termination of Occupancy Upon termination of occupancy of a County Assisted Unit by a Tenant, such Unit will be deemed to be continuously occupied by a household of the same income level as the initial income level of the vacating Tenant, until such unit is reoccupied, at which time categorization of the Unit will be established based on the occupancy requirements of Section 2.1.

  • Certificate of Occupancy The Contractor’s obligation under the Contract is to install the Work in accordance with the Contract Documents, obtain the Certificate of Occupancy from the State Fire Marshal or his deputy, and forward it to the Design Professional as a part of the final close out procedures. The Design Professional’s obligation is to design the Work to comply with the applicable codes and to qualify for a Certificate of Occupancy.
