Search of Passenger or Property. When the Customer refuses to submit to electronic surveillance or to permit search of his or her person or property. Cape Air is not liable for its refusal to transport any Customer or for its removal of any Customer in accordance with this Section. A Customer who is removed or refused transportation may be eligible for a refund, upon request, as the Customer’s sole and exclusive remedy. Any Customer who, by reason of engaging in the above activities in this Section, causes Cape Air any loss, damage or expense of any kind, consents and acknowledges that he or she shall reimburse Cape Air for any such loss, damage or expense. Cape Air has the right to refuse, on a permanent basis, any Customer who, by reason of engaging in the above, causes Cape Air any loss, damage or expense of any kind, or has been disorderly, offensive, abusive or violent.
