Section 3 and MBE/WBE Goals and Obligations In accomplishing its development activities as provided herein, the Developer will comply with Section 3 of the Housing and Urban Development Act of 1968 and implementing regulations thereunder by training and hiring public housing residents and lower-income community residents to the greatest extent feasible. The Developer shall also make best efforts (and shall obligate its General Contractor to make best efforts) to comply with the Authority’s Section 3 plan, as it may be amended by the Authority’s Board of Comissioner’s; costs related to meeting the goals of the plan shall be factored into the Development Budget. The Developer shall make best efforts (and shall obligate its General Contractor to make best efforts) to provide 10% of construction subcontracting opportunities and 3% of non-construction subcontracting opportunities to Section 3 businesses and to cause 30% of new hires (including trainees) to be Section 3 employees. The Developer shall also use (and obligate its General Contractor to use) best efforts to provide 25% of construction subcontracts to Minority-Owned Business Enterprises and 5% of construction subcontracts to Woman-Owned Business Enterprises. The Developer shall include reports about efforts and results relating to such Section 3 with any draw for payment of predevelopment, construction and/or Additional Services expenses, and shall include final reports about such matters within thirty (30) days of the completion of activities.
