Selection of and Refusal to Select Open Runs. Regular runs, relief runs, vacation runs coming open between xxxx-ups and remaining open after line, relief run or vacation run xxxx-ups, may be selected in seniority order by operators on the Extra Board, beginning with the oldest operators in point of service. If operators prefer to remain on the Extra Board, they may elect to do so. Operators failing to pick relief runs when called to their attention that it is their turn to select, will be passed up and the next operator will be permitted to pick his relief runs. Such operators passed up will then select their relief runs from runs still available.

  • CONDITIONS APPLICABLE PENDING TRANSFER As has already been referred to in this agreement, the common property will be owned and controlled by a body corporate for and on behalf of all owners including the purchaser. As the body corporate will only be established once the first transfer of a unit in the development has occurred, the Seller shall from the completion date and until the date of the establishment of the body corporate bear the rights and obligations of the body corporate.   • Forum Selection Any legal action or proceeding with respect to this Agreement or the services provided hereunder or for recognition and enforcement of any judgment in respect hereof brought by the other party hereto or its successors or assigns must be brought and determined in the state courts of the Commonwealth of Massachusetts or the United States District Court for the District of Massachusetts (and may not be brought or determined in any other forum or jurisdiction), and each party hereto submits with regard to any action or proceeding for itself and in respect of its property, generally and unconditionally, to the sole and exclusive jurisdiction of the aforesaid courts.

  • Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion - Lower Tier Covered Transactions (a) The prospective lower tier participant certifies, by submission of this proposal, that neither it nor its principals is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any federal department or agency.
