Shift Selection. Employee assignments within the Patrol Bureau will occur between approximately April 1-15 and shall be awarded based upon seniority. Approximately three (3) months before then the Department will publish a call for written requests on shift assignment. Employees will make their first three (3) choices known. Employees will learn of the assignment, including days off associated with their assignment, immediately after the bidding process is completed. Assignments will take effect on the schedule immediately following July 1st. Residence Hall assignments will be made prior to all others. No officer will be required to work a Residence Hall assignment in consecutive years. Assignment of the remaining officers will begin with selection(s) for day and night shifts. The bid for assignments will continue until all positions are filled. The following general rules apply to assignments:
1. During the term of this Agreement, no employee will be reassigned to a different shift other than the shift awarded by seniority except in situations where the University cannot continue to provide police services. In the event a shift reassignment must occur, it will be offered to volunteers based on seniority. If there are no volunteers it will be assigned to the least senior officer in the department.
2. Shift selection shall be an appropriate subject for the Joint Labor/Management Committee.
3. If a shift becomes available as a result of trainees being released for duty, and if there is at least four (4) months until the next shift change, the shift will be posted and awarded by seniority. The new trainee released for duty will take the senior officers shift. If no employee desires the shift, the trainee scheduled for assignment will be assigned that shift. The parties recognize that for the betterment of the Department it may be necessary to assign a trainee to a specific shift.
4. Voluntary shift trades will be allowed as long as overtime costs are not incurred.
5. Except in a bona fide emergency, no employee shall be assigned to work more than sixteen (16) hours in a twenty-four (24) hour period, provided however employees may volunteer to work up to eighteen (18) hours in a twenty-four (24) hour period.
Shift Selection. Shift selection, whether under permanent, rotating or other conditions, in the positions of Police Officer and Police Specialist in the Cincinnati Police Department shall be according to seniority as determined by date of appointment as a Police Recruit. Members transferred to another District shall, immediately upon transfer, select his/her shift by seniority. Nothing in this Section shall preclude the Chief of Police from assigning employees to shifts based upon the needs of the Department. A bargaining unit member who returns to service as a Cincinnati Police Officer following resignation from the Cincinnati Police Department shall use his/her date of appointment as a police recruit for purpose of shift selection subject to any restrictions contained in this section.
Shift Selection. In multiple shift operations, employees within each classification shall have a right to select their work shift on the basis of their seniority within a bureau or division thereof and competing only with employees covered under this agreement on the following basis:
12.1.1 After the employee's original selection of a work shift, changes may be made only when a vacancy occurs on another shift; provided, however, if the City eliminates any employee's shift, such employee shall have the right to exercise their seniority to select one of the existing shifts.
12.1.2 Shift trades or individual shift changes may be made by mutual agreement between the employees and the City, provided such changes are posted and there are not objections. However, any such mutually agreed changes shall not be subject to the overtime provisions of this agreement.
12.1.3 Group shift changes may be made by mutual agreement between the Union and the City. However, any such mutually agreed changes shall not be subject to the overtime provisions of this agreement.
12.1.4 When shift changes are made which are beyond the control of the City, the overtime provisions of this contract will be waived.
Shift Selection. (1) Seniority shall be used in shift selection with shift bid periods occurring twice per year in January and July with implementation occurring the start of the last full pay period in March and September, top seniority having first choice, and so on, excepting however, probationary and non-authorized drivers shall be assigned by the Director or his/her designee.
(2) The Director of EMS or his/her designee reserves the right to place up to six (6) employees per bid period if necessary to effectively coordinate staffing.
(3) The Director or his/her designee agrees not to change the shift selection, unless unforeseen scheduling conditions warrant such action, such as staff shortages. However, the Director or his/her designee agrees to notify the Local Association President, prior to any change in the selected schedule.
(4) Employees may exchange shifts with the approval of the Director or his/her designee.
Shift Selection. A. District and section commanders are responsible for scheduling employees for duty. Shifts shall not be scheduled for rotation more frequently than twenty-eight (28) days, except in emergency situations as defined in this Article. Except as specified below, shift selection shall be determined by the Employer.
B. Shifts in an assignment shall be selected by seniority provided the majority of the employees in the assignment vote for the assignment of shifts by seniority. A vote to start or stop shift bidding shall be conducted if at least thirty percent (30%) of the bargaining unit members in the assignment request such a vote. Such a vote shall be conducted no more than once annually. The vote shall be supervised by one (1) representative of the Employer and one (1) representative of the Association. The Employer shall post the results of the vote no later than two (2) weeks after the vote. An employee involuntarily transferred to an assignment shall have the right to exercise his/her seniority to select a shift no sooner than thirty (30) calendar days after the initial date of transfer; an employee voluntarily transferred to an assignment may not use his/her seniority to select a shift until the next annual shift selection. Shift assignments selected under Subsection 12.9 B shall be evidenced by an Interoffice Communication (IOC) and shall not require a Memorandum of Understanding (MOU).
C. The supervisor has the right to change both the schedule and the assigned employee at any time if an emergency arises or if overriding reasonable operating needs exist which require the change.
Shift Selection. If two or more employees were promoted on the same day from the same promotional list, seniority shall be determined by final overall numerical promotional examination rankings. Members transferred to another District shall, immediately upon transfer, select his/her shift by seniority. Nothing in this Section shall preclude the Chief of Police from assigning employees to shifts based upon the needs of the Department. A bargaining unit member who returns to service as a Cincinnati Police Officer following resignation from the Cincinnati Police Department shall use his/her date of appointment as a police recruit for purpose of shift selection to any restrictions contained in this section.
Shift Selection. A. Shift selection will be based on a bid process, with each employee requesting shifts in order of preference or indicating no preference.
1. Employees will receive bid sheets at least four (4) pay periods prior to the scheduled shift change, but will have access to bid sheets at all times.
2. Employees will be given an open period of one (1) pay period to complete, update, and submit bid sheets.
3. The shift assignments will normally be posted two (2) pay periods prior to scheduled shift rotation.
4. In the event an employee fails to submit a bid-sheet or does not have one on file, the employee will be assigned to a shift at the discretion of the Agency.
5. At the end of the open period, the designated management official will sort the employees’ shift-bid requests in order of seniority for each requested shift.
B. Shift bid requests will remain on file and used for future shift-bid assignments until an employee submits a new shift request. New or updated requests may be submitted at any time. Requests submitted outside the open period will not be considered until the next open period.
C. All employees who are expected to be assigned to a shift at their location for the upcoming shift rotation should complete a bid sheet if they do not have one on file or wish to update their preference.
D. Except as stated herein, shift assignments will be based on seniority.
E. Shift swaps may be requested at any time, consistent with the Collective Bargaining Agreement.
F. Shift requests based on special circumstances will be considered and may be approved by management on a case by case basis after an employee has exhausted attempts to voluntarily swap shifts.
Shift Selection. Shift selection shall be by the following process:
15.1.1 Work groups shall be allowed to determine whether or not to bid shifts. A vote may occur once every fiscal year to start or stop shift bidding. The vote may be conducted only if thirty percent (30%) of the affected bidding employees in a work group request such a vote. The vote must occur in October and become effective at the start of the first twenty- eight (28)-day cycle commencing after January 1 of the next year. A minimum of a majority of the affected employees is required for starting or stopping shift bidding. Employees are not eligible voters until the completion of the probationary period. The Association representative at the work site shall conduct the election, certify the results to the supervisor, and supply a list of eligible employees in seniority order to the supervisor.
15.1.2 If the work site elects to bid shifts, the following shall occur:
15.1.2.1 The supervisor shall establish the number of shifts, and the specific hours when they occur.
15.1.2.2 The eligible employees will bid, by seniority, for the shift. Employees on unpaid leave of absence at the time of the bid shall not be eligible to bid. An employee who is still in training and not on solo status in their classification is not eligible to bid. Once released from training and in solo status in their classification the employee will be assigned a shift. If the shift assigned was not available at the time of the bid, then on the basis of seniority a senior employee may elect that shift, in that case the probationary employee will be assigned the vacated shift.
15.1.2.3 The supervisor has the right to change both the schedule and the assigned employee at any time provided the supervisor has a reasonable operational need for making the change.
15.1.2.4 Each work group will determine whether to bid on a minimum of three (3), twenty-eight (28)-day blocks or on a block of no greater than thirteen (13), twenty-eight (28)-day periods. No employees may bid the same shift for more than thirteen (13), twenty-eight (28)-day periods unless the vote to start shift bidding specifies that employees are not restricted in the length of time they can remain on any one shift.
