SELLER’S RIGHTS AND DUTIES. 5.1 The Seller will be required to communicate effectively (as defined below) with the Buyer at all stages of this Contract in order to resolve any technical issues or problems that arise in a timely and efficient manner.
SELLER’S RIGHTS AND DUTIES. In connection with the Removal, Seller shall: (i) provide the Buyer with physical access to the Facility necessary for the Removal, (ii) cooperate with Buyer to obtain all necessary governmental consents, permits and licenses to permit the Removal (including the right to remove walls, etc. to the extent reasonably necessary to accomplish the Removal), and (iii) maintain public liability insurance during the course of the Removal in such amounts as have been historically maintained by Seller.
SELLER’S RIGHTS AND DUTIES. 1.The main duty of the seller under the FOB contract is loading. The seller must deliver the goods on board the vessel, at a place where the buyer has already identified as the port of loading and within the period of shipment which the parties indicated in the contract of sale. Name of the port in a FOB contract is a condition. For instance, the seller sends the goods to the other port from the port where it has been identified in the contract of sale. The seller commits a breach of a condition, so the buyer is entitled to refuse the delivery of the goods.1 1 Manbre S. Co. Ltd. v Corn p. Co. Ltd. However, in contrast to an FOB contract, the seller can also procure the goods afloat which are already shipped.
