Common use of Service Availability Service Credit Clause in Contracts

Service Availability Service Credit. If a Customer believes that Rogers has failed to meet an applicable Service Availability commitment for a particular Optical Wavelength circuit in any given billing month, then the Customer must contact their Rogers’ sales representative and apply for a Service Credit within fifteen (15) Business Days starting from the fifteenth (15th) day of the following billing month. Upon Rogers’ verification that the Service Availability for a particular Optical Wavelength circuit over a given billing month was less than the committed Service Availability metric for reasons other than Acceptable Downtime, Rogers will issue a Service Credit to the Customer. The Service Credit will equal the applicable amount from Table 2 for the monthly recurring charges for the affected Optical Wavelength circuit(s) in the applicable month. Service Availability Metric Service Credit Optical Wavelength Service 99.90% 10% of the monthly recurring Optical Wavelength Services charges for the affected Optical Wavelength circuit(s) Table 2 – Service Availability Commitment
